RESOLUTION TO APPROVE THE REQUEST OF EASTERN CONSULTING,
INC., BY MARK S. STIRES, P.E., BRANCH MANAGER, FOR SPECIAL
EXCEPTIONS TO CHAPTER 26 OF THE CITY CODE ON THE PREMISES
KNOWN AS FAIR.FAX CITY MOBIL SERVICE STATION, 11098 MAIN
STREET, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL
57-1-((02))-39C.
WHEREAS, Eastern Consulting, Inc., by Mark S. Stires, P.E., Branch Manager, has
submitted application No. SE-123-93-1, requesting Special Exceptions to the City Code listed
below:
Section 26-43(a) and (8) to allow a sign to be less than the required 20 feet
(approximately six feet) from all property lines and the public right-of-way; and
Section 26-44(a) Table II to allow a sign area to be greater than the permitted 32
square feet (approximately 44 square feet).
WHEREAS, City Council has determined that the proposed Special Exceptions are
appropriate because the proposal meets the requisites established by City of Fairfax Code
Sections 26-48 and 26-103(c) for the following reasons:
The existing site design precludes placement of a ground-mounted sign that is
both visible to the public and in compliance with the required 20-foot setback.
The proposed sign will not negatively impact existing traffic patterns, adjacent
property, or pedestrian safety.
The proposed sign is consistent with the purpose of the Sign Ordinance and
goal of the Comprehensive Plan to provide for adequate and well-designed
signage.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax
on this 9th day of November, 1993, that application Ne,. SE-123-93-1 be and hereby is
APPROVED with the following conditions:
The sign message be consistent with, and the sign be oriented as shown in, the
plans prepared by Eastern Consulting, Inc., dated September 10, 1993, that
were submitted with this application (SE-123-93-1).
The landscaped island containing the sign. be re-landscaped in coordination
with the staff to include evergreen shrubs, and ornamental plantings.
A dumpster enclosure be installed to screen all refuse and recycling containers
concurrent with the proposed sign's insta;tlation.
Evergreen trees be installed as shown in 'the plans prepared by Eastern
Consulting, Inc., dated September 10, 1993, that were submitted with this
application (SE-123-93-1).
The station owner/operator develop and maintain a system for monitoring
vehicles on-site to ensure prompt removal of abandoned or junk vehicles.

The station owner/operator properly maintain on-site landscaping, and
promptly replace dead or damaged materials.
