RESOLUTION TO APPROVE THE REQUEST OF
WHEELER DEVELOPMENT GROUP, INC., FOR
SPECIAL EXCEPTIONS TO THE CODE OF THE
CITY OF FAIRFAX, VIRGINIA, ON THE PREMISES
KNOWN AS BOULEVARD SHOPPING CENTER,
10670-10708 LEE HIGHWAY.
WHEREAS, Wheeler Development Group, Inc., has submitted
ion No. SE-102-92-1 requesting Special Exceptions to the
City Code listed below:
Section 26-43(a)(3) and (8) to allow a free-standing iden-
tification sign to be located less than 20 feet from the
right-of-way;
Section 24-44(b)(2)(a)(1) to allow a free-standing identifica-
tion sign taller than the permitted six feet and in addition
to an existing free-standing tenant sign;
Section 26-39.1(h)(2) and (3) to allow a building addition in
a shopping center which is non-conforming with respect to
Division 6 (Off-Street Parking and Loading) without providing
the required parking lot improvements;
Section 26-39.4(b)¢3) to allow construction of a retail
building addition without providing the required number of
parking spaces;
Section 26-69(a)¢1) to allow a front landscape strip less than
the required 25 feet.
WHEREAS, City Council has determined that the proposed Special
Exceptions are appropriate because the proposal as modified by the
below-listed conditions meets the requisites established by City
of Fairfax Code Sections 26-39.4, 26-48(b), 26-71.2, and 26-103(c)
for the following reasons:
1. The proposal mitigates existing negative conditions by
providing for safe pedestrian and vehicular circulation
and introducing significant landscaping and screening
materials to the site.
2. The proposal is consistent with the Comprehensive Plan
goal to renovate existing nonconforming development
within the Lee Highway Corridor.
3. The proposal will produce no negative impacts to nearby
property, or to residents and workers in the community.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Fairfax on this 27th day of October, 1992, that application No.
SE-102-92-1 be and hereby is APPROVED with the following condi-
tions:
The existing pylon sign be removed as stated by the
applicant;
The proposed ground-mounted sign face be no more than 50
square feet in area and the overall sign height be no
more than 8.5 feet;
The proposed sign be located to provide adequate site
distance in compliance with Section 26-14.1 of the City
Code;
A concrete walk be installed along Lee Highway in
coordination with Public Works;

Two additional trees be planted in the landscape strip
along Lee Highway in front of the Magruder's building,
one on either side of the new driveway and an evergreen
hedge be planted as required by Section 26-69(a)(1);
Two trees be planted in front of the Danker building;
Two trees and ornamental plantings be installed in the
triangular landscaped area which is near the intersection
of Warwick Avenue and Lee Highway;
The location of the proposed fence along Warwick Avenue
be adjusted to provide adequate site distance in
compliance with Section 26-14.1;
A recycling program be instituted for the entire shopping
center and the recycling and refuse containers for the
individual tenants be consolidated as much as possible;
The gross floor area of the existing and proposed
buildings be used to calculate the number of required
parking spaces, and the number of parking spaces provided
on-site be no less than 80 percent of the total amount
required;
A signalization plan at the entrance to the shopping
center on Route 50 be determined between Wheeler
Development Group, Inc., and the City, and that Wheeler
Development Group escrow $40,000 for a period of two
years to cover one-half of the cost of the signalization.
