R-92- 61 RESOLUTION TO APPROVE THE REQUEST OF HOMEBUILDERS INVESTMENT, L.P., BY DENNY VORBAU, DIRECTOR OF ADMINISTRATION, FOR SPECIAL EXCEPTIONS TO THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, FOR PROPERTY LOCATED AT THE INTERSECTION OF SAGER AVENUE AND JOHN TRAMMELL COURT, TAX MAP PARCEL 57-4-((28))-8. WHEREAS, Homebuilders Investment, L.P., by Denny Vorbau, Director of Administration has submitted application No. SE-106-92-1 requesting Special Exceptions to the City Code Sections listed below: Section 26-43(a)(3) and (8) and 26-44(a) Table I - in order to allow a residential development identification sign to be less than the required 20 feet (approximately ten fee0 from the public right-of-way and all property lines. WHEREAS, City Council has determined that the proposed Special Exceptions are appropriate because the proposal meets the requisites established by City of Fairfax Code Section 26-48 and 26-103(c) for the following reasons: The development's subdivision and site design presents a unique burden due to the narrowness of the common areas adjacent to the development's entrance. o Granting the requested Special Exceptions is not inconsistent with the purpose of the Sign Ordinance to provide for adequate but not excessive signage and is in concert with the Comprehensive Plan goal for well- designed signs. e Granting the requested Special Exceptions will not produce any negative impacts to the community. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 15th day of December, 1992, that application No. SE-106-92-1 be and hereby is APPROVED. ATTEST: Ci~ly Cl~rk
