A RESOLUTION AUTHORIZING THE CITY
MANAGER, ON BEHALF OF THE CITY OF
FAIRFAX, VIRGINIA, TO EXECUTE CERTAIN
DOCUMENTS CONCERNING THE CONVEYANCE AND
ACCEPTANCE OF REAL ESTATE, CONVEYANCE OF
EASEMENTS, AND APPROVAL OF A DESIGN AND
CONSTRUCTION AGREEMENT AMONG THE BOARD
OF THE NORTHERN VIRGINIA CRIMINAL
JUSTICE ACADEMY AND VARIOUS NORTHERN
VIRGINIA JURISDICTIONS FOR THE PRINCE
WILLIAM COUNTY PUBLIC SAFETY TRAINING
CENTER IN NOKESVILLE, VIRGINIA.
BE IT RESOLVED, by the City Council of the City of
Fairfax, Virginia, that
1. city Council accepts the conveyances, by the
attached deeds (Attachments 1 and 2), of the interests of
the Town of Herndon and the Town of Leesburg in 139.50 acres
of real estate (the "Academy Property") held in trust by the
Board of the Northern Virginia Criminal Justice Academy (the
"Academy"), and the City Manager is hereby authorized to
execute the deeds and all other documents necessary to
accept such conveyances on behalf of the city of Fairfax as
a member of the Academy.
2. The City Council hereby approves the Design and
Construction Agreement (Attachment 3), and authorizes the
city Manager to execute the agreement on behalf of the City.
3. The City Council hereby accepts the conveyance of
approximately 0.90 acres, more or less, from Robert L.
Fischer and Ruth D. Fischer, Trustees of the Robert L.
Fischer and Ruth D. Fischer Revocable Trust (the "Fischers")
to the Academy Board pursuant to a Boundary Line Agreement
with the Fischers (Attachment 4) and authorizes the City
Manager to execute such deeds and other agreements as
necessary to indicate the City's acceptance of such
conveyance as a member of the Academy.

4. The City Manager is authorized to execute such
documents as may be necessary to convey or accept easements
to carry out the intent of the Design and the Construction
Agreement, as such conveyances or acceptances may be
necessary or desireable for the construction, maintenance
and operation of the facilities described therein.
5. The City Council hereby approves a conveyance of
an easement right-of-way at 15' in width from the Academy
Board to the CNG Transmission Corporation across the Academy
property for the purpose of installing, using and
maintaining a 24" gas transmission pipeline, and authorizes
the city Manager to execute such documents that are
necessary to approve the conveyance of such easement right-
of-way.
