A RESOLUTION TO APPROVE THE REQUEST OF FAIRFAX CAR WASH,
INC., BY MELVIN BURKE, PRESIDENT, FOR SPECIAL EXCEPTIONS
TO CHAPTER 26, ARTICLE II, DIVISION 7, OF THE CODE OF THE
CITY OF FAIRFAX, VIRGINIA, FOR PROPERTY LOCATED AT 10874
LEE HIGHWAY, AND MORE PARTICULARLY DESCRIBED AS TAX MAP
PARCEL NO. 57-1-( (02))-048C
WHEREAS, Fairfax Car Wash, Inc., by Melvin Burke, president,
has submitted application No. SE-82-91-3, requesting special
exceptions to the City Code listed below:
Section 26-43(a) (3): To permit a ground-mounted sign to be
set back 6 feet from the right-of-way where a 20-foot set back
is required.
Section 26-43(a) (7): To permit a ground-mounted sign on a lot
with less than the required 100-foot road frontage.
Section 26-44(a) and Table II: To permit a sign area of 33
square feet where 24 feet is allowed.
Section 26-44(a) and Table II: To permit a sign height of ten
feet where six feet is allowed.
WHEREAS, City Council has determined that the proposed special
exceptions numbered 1 - 4 above are appropriate because they meet
the requisites established by City of Fairfax Code Sections 26-
48(b)(1) and (2) and 26-103(c) (1-11) for the following reasons:

The applicant has demonstrated that compliance with City
Code sign regulations will present a unique burden due
to landscaping, building location, and site design, and
The granting of these special exceptions will not be
inconsistent with the Comprehensive Plan or the purpose
of the sign regulations as stated in Section 26-40, and

These special exceptions as modified by the below-stated
conditions meet the criteria of Section 26-103(c).
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Fairfax, on this 9th day of July, 1991, that special exceptions
numbered 1 - 4 described above and in Application No. SE-82-91-3
be and hereby are approved, subject to the following conditions:
The proposed location of the sign be coordinated with the
staff, the distance not to exceed six feet west of the
proposed location;
The area around the sign be landscaped in coordination
with the staff;
3. The height of the proposed sign be ten feet maximum.
