19910723 r-91-28RESOLUTION NO. R-91-Z8 A RESOLUTION EXTENDING THE CLOSING DATE OF THE SALE TO PHILLIP W. DUTTON OF SURPLUS CITY REAL ESTATE AT 4117 CHESTNUT STREET. WHEREAS, on May 14, 1991, by Ordinance No. 1991-12, the City Council of the City of Fairfax, Virginia declared the real estate at 4117 Chestnut Street to be surplus City property, accepted the offer of Phillip W. Dutton dated March 28, 1991 to purchase the real estate (the "Offer"), authorized the real estate to be sold to Mr. Dutton, and authorized a deed to be executed by the City Manager on behalf of the City; WHEREAS, Paragraph 7 of the Offer obligated Mr. Dutton to close within 60 days after May 14, 1991 (i.e., by July 13, 1991); WHEREAS, Mr. Dutton, through the office of her settlement attorney, requests that this time period be extended; and WHEREAS, by this Resolution, the City Council agrees to extend the time period as provided herein. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax, Virginia, that the City hereby agrees to and accepts an amendment to Paragraph 7 of an Offer To Purchase Real Estate Dated March 28, 1991 from Phillip W. Dutton to the City of Fairfax, to provide that Mr. Dutton shall be obligated to close no later than September 10, 1991. BE IT FURTHER RESOLVED that all other provisions the Offer and acceptance thereof by the City shall remain in full force and effect. ADOPTED this 23rd day of July 1991. Attest: (Acting) City Clerk
