19911015 r-91-34RESOLUTION NO. R-91-34 RESOLUTION TO APPROVE THE REQUEST OF FAIRFAX UNITED METHODIST CHURCH, BY ARTHUR H. LOONEY, CHURCH ADMINISTRATION, FOR SPECIAL EXCEPTIONS TO THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, FOR SIGNAGE FOR PROPERTY LOCATED AT 10300 STRATFORD AVENUE WHEREAS, Fairfax United Methodist Church has submitted application No. SE-84-91-1 requesting special exceptions to the City Code listed below: Chapter 26, Article II, Division 7 Section 26-44(a) To permit a free-standing sign larger than the maximum of 24 square feet allowed (40 square feet); Section 26-44(a) To permit a free-standing sign taller than the six feet allowed (6.88 feet); Section 26-43(a)(3) To permit a free-standing sign to be less than the required twenty feet from the property line (fifteen feet); Section 26-44(a) To permit an internally illuminated sign instead of the external white light allowed; pursuant to Section 26-48. WHEREAS, City Council has determined that the proposed special exceptions numbered 1-3 above and in application SE-84-91-1 are appropriate because the proposal meets the requisites established by City of Fairfax Code Section 26-48(b)(1) and (2) and 26- 103(c)(1-11) for the following reasons: The applicant has demonstrated that compliance with City Code regulations will present a unique burden due to landscaping and topography, and The granting of these special exceptions will not be inconsistent with the Comprehensive Plan or the purpose of the sign regulations as stated in Section 26-40, and These special exceptions as modified by the below stated conditions meet the criteria of Section 26-103(c). NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 15th day of October, 1991, that special exceptions numbered 1-3 described above and in application no. SE- 84-91-1 be and hereby are APPROVED, subject to the following conditions: The area around the sign be landscaped in coordination with the staff; The bushes around the old sign near the corner be examined by a member of the City staff and the church to determine if they can be cut back or reduced to ensure proper sight distance.
