A RESOLUTION TO APPROVE THE REQUEST OF OLD LEE
PLAZA, PHASE II, BY THE HERSAND COMPANIES,
INC., HERBERT L. AMAN, III, PRESIDENT, FOR A
SPECIAL EXCEPTION TO THE CITY CODE OF THE CITY
OF FAIRFAX, VIRGINIA, SECTION 26-39.7(C), TO
REDUCE THE NUMBER OF PARKING SPACES REQUIRED
BY SECTION 26-39.4 (S) (3) (J) TO ALLOW 100
PERCENT BUILDING OCCUPANCY BY MEDICAL/DENTAL
OFFICES AND CLINICS
WHEREAS, Old Lee Plaza Limited partnership, by The Hersand
Companies, Inc., Partner, Herbert L. Aman, III, President, has
submitted application No. SE-85-91-1, requesting a special
exception pursuant to City Code Section 26-39.7(c) to reduce the
number of parking spaces required by Section 26-39.4(b)(3)(j) to
allow 100 percent building occupancy by medical/dental offices and
clinics;
WHEREAS, City Council has determined that a modified version
of the proposed special exception which allows the required parking
for the proposed radiation treatment facility described in
Application No. SE-85-91-1 to be calculated as follows:
Four parking spaces shall be provided for each exam or
treatment room and one parking space shall be provided for each
individual working at the facility.
WHEREAS, City Council has determined that this modified
version of the request is appropriate because it meets the
requisites established by City of Fairfax Code Sections 26-39.7(c)
and 26-103(c) for the following reasons:
The approved reduction in required number of parking
spaces will not result in increased traffic congestion
or otherwise negatively impact existing traffic flow or
pedestrian and vehicular safety;
The approved reduction will permit the reasonable use of
the subject property and will not result in negative
impacts to surrounding area.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Fairfax on this 15th day of October, 1991, that application No.
SE-85-91-1 be and hereby is APPROVED.
