RESOLUTION TO APPROVE THE REQUEST OF COUNTRY CLUB HILLS CIVIC
ASSOCIATION, BY ROBERT A. WILLARD, PRESIDENT, FOR SPECIAL
EXCEPTIONS TO THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, FOR
SIGNAGE FOR PROPERTY LOCATED AT OLD LEE HIGHWAY ADJACENT TO 3419
COUNTRY HILL DRIVE, 3435 BROOKWOOD DRIVE AND 3521 OLD POST ROAD
WHEREAS, Country Club Hills has submitted application No. SE-86-91-1 requesting
special exceptions to the City Code listed below:
Section 26-43(a)(3) To allow residential development identification signage to be located in
the public right-of-way where a twenty-foot setback is required.
Section 26-44(a)(Table I) To allow more than the two permitted residential development
identification signs (3 signs).
Section 26-44(a)(Table I) To allow freestanding signage other than the ground-mounted
style permitted.
WHEREAS, City Council has determined that the proposed Special Exceptions are
appropriate because the proposed development meets the requisites established by City of Fairfax
Code Section 2648 for the following reasons:
The applicant suffers a unique burden because the subdivision design and wide
right-of-way on Old Lee Highway would hinder the visibility of signs placed at the
required setback.
Granting the Special Exceptions will be consistent with the Comprehensive Plan as
the installation of identification signs will enhance the neighborhood and foster
civic pride. The proposed signs are compatible with the intent of the Sign
Ordinance which is to provide for adequate but not excessive signage.
NOW, THEREFORE, BE 1T RESOLVED by the City Council of the City of Fairfax on
this 10th day of December, 1991, that application No. SE-86-91-1 be and hereby is APPROVED
with the following conditions:
The precise location of the signs to be approved in the field by the Public Works
Director prior to installation of the signage;
The construction of the signs to be such that the posts will "break-away" if struck
by a motor vehicle;
Any relocation of the signs required because of the widening of Old Lee Highway
to be the responsibility of the Civic Association and subject to the joint approval of
the Public Works Director and the Zoning Administrator.
The City Council will refund the fee associated with the application from City
Council contingency account 411010-530513.
