A RESOLUTION TO APPROVE THE REQUEST OF E.L. KELLOGG, TRUSTEE,
FOR CIRCLE PLAZA SHOPPING CENTER, FOR SPECIAL EXCEPTIONS
TO THE SIGN ORDINANCE, ON THE PREMISES KNOWN AS CIRCLE
PLAZA SHOPPING CENTER, LOCATED AT 3210 - 3242 OLD PICKETT
ROAD AND MORE PARTICULARLY DESCRIBED AS TAX MAP 48-3-((7))-3.
WHEREAS, E. L. Kellogg, Trustee for circle Plaza Shopping
Center, has submitted application No. SE-75-90-1 requesting
Special Exceptions to the City Code listed below:
Section 26-43(a)(3) to allow a free-standing ground-mounted
sign to be located 16 feet from the right-of-way where a
20-foot setback is required.
Section 26-43(a) (4) to allow a building-mounted sign to
extend above the roofline.
WHEREAS, City Council has determined that the proposed
Special Exceptions are appropriate because the proposed
development meets the requisites established by City of Fairfax
Code Sections 26-48(b) (1) and (2) and 26-103(c) (1)-(11) for the
following reasons:
1. The applicant has clearly demonstrated that require-
ments contained in this Division will present a unique
burden due to unusual topography, vegetation, building
design or lot shape; and
The City Council has determined that the granting of
Special Exceptions will not be inconsistent with the
Comprehensive Plan or the purpose of this Division as
stated in Section 26-40.
The criteria of Section 26-103(c) have been considered
and the request is consistent with the criteria.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Fairfax, on this 24th day of July, 1990, that applica-
tion No. SE-75-90-1 be and hereby is APPROVED subject to the
following conditions:
Existing landscaped areas must be maintained to a
standard acceptable to the City, including remulching,
more frequent weeding and mowing, and watering as
needed.
The new lightpoles shown on the plan must be the
gooseneck style noted in the Community Appearance
Plan.
Additional deciduous street trees must be planted in
the front landscaped areas to complete the planting
schedule shown in the Community Appearance Plan.

The storage trailer located in the back of the parking
area adjacent to Hume Avenue must be removed.
The trash dumpsters located in the service drive
behind the stores must be reorganized and screened
from view from Old Pickett Road and Foxcroft Colony
Condominiums.
