A RESOLUTION TO APPROVE THE REQUEST OF FAIR LEE ASSOCIATES BY
JAMES A BRANTLEY, MANAGING GENERAL PARTNER, FOR SPECIAL
EXCEPTIONS TO THE SIGN ORDINANCE ON THE PREMISES KNOWN AS
HAMPTON INN LOCATED AT 10860 LEE HIGHWAY AND MORE PARTICULARLY
DESCRIBED AS TAX MAP 57-1-((2))-49A.
WHEREAS, Fair Lee Associates by James A. Brantley, Managing
General Partner for Hampton Inn, has submitted application No. SE-
76-90-3 requesting Special Exceptions to the City Code listed
below:
Section 26-43(a) (3): to permit a ground-mounted sign to be
set back 3 feet from the right-of-way where a 20-foot
separation is required.
Section 26-44(a) and Table II: to permit a ground-mounted
sign to have a height of 10 feet where 6 feet is the maximum
height allowed.
WHEREAS, City Council has determined that the proposed Special
Exceptions are appropriate because the proposed development meets
the requisites established by City of Fairfax Code Sections 26-
48(b) (1) and (2) and 26-103(c) (1) for the following reasons:
The applicant has clearly demonstrated that requirements
contained in this Division will present a unique burden
due to unusual topography, vegetation, building design
or lot shape; and
The City Council has determined that the granting of
Special Exceptions will not be inconsistent with the
Comprehensive Plan or the purpose of this Division as
stated in Section 26-40.
The criteria of Section 26-103(c) have been considered
and the request is consistent with the criteria.
NOW, THEREFORE, BE IT RESOLVED kY the City Council of the city
of Fairfax on this ~ day of ~~. ~ , 1990, that
application NO. SE-76-90-3 be and ~er~by is APPROVED subject to the
following conditions:
The sign location be moved to a point 35 feet from
the entrance to the property from Lee Highway and
the sign set back 8 feet from the property line;
The sign height, including planter, not exceed 10
feet;
The base of the sign be landscaped with appropriate
perennial shrubs and flowers as determined in
coordination with City staff.
