19890314 r-89-10 R'89-10 RESOLUTION NO. A RESOLUTION TO APPROVE THE REQUEST OF FAIRFAX CAR WASH, INC., BY MELVIN BURKE, PRESIDENT, T/A EMBASSY AUTO WASH FOR SPECIAL EXCEPTIONS FROM SPECIFIED PROVISIONS OF CHAPTER 26 OF THE CODE OF THE CITY OF FAIRFAX FOR PROPERTY LOCATED AT 10874 LEE HIGHWAY AND MORE PARTICULARLY DESCRIBED AS TAX MAP 57-1-((2))48C WHEREAS, Melvin Burke has submitted Application No. SE-49-89-2 requesting the special exceptions to the City Code as listed below: 1. Section 26-39.2¢e)(2): To permit a perimeter landscaped area adjacent to a parking/drive area that is less than the required 12 feet; 2. Section 26-178(c)(2): To permit building side yard of five feet where 25 feet is required; and 3. Section 26-178(d): To permit open space of 13.8% where 20% is required. WHEREAS, City Council has determined that the proposed special exceptions are appropriate because the proposed development meets the requisites established by Fairfax City Code Section 26-39.7(c) and Section 26-178(f)(2) for the following reasons: Section 26-39.7(c): 1. Will not result in increased traffic condition or otherwise negatively impact existing traffic flow or pedestrian or vehicular safety; 2. Will not be contrary to the objective specified in the Comprehensive Plan; 3. Will permit the reasonable use of the subject property; and 4. Will not adversely impact adjacent property or the surrounding area. Section 26-178¢f)(2): o Will not result in development which is disproportionate to surrounding land uses; Will not adversely affect adjacent residential areas; Will not overburden the existing community facilities; and Will not be contrary to the objectives of the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 14th day of March, 1989, that Application No. SE-49-89-2 be and hereby is APPROVED with the following conditions: o ° The two-foot landscaping strip along the east property line be included in the project; The dumpster area be completely screened with a fence of a material compatible with the wall material and painted the same color to blend in with the building; The landscaped front area be planted with trees in accordance with the Community Appearance Plan; The curb, gutter and sidewalk must be replaced as needed; The service drive must be repaved; and The sidewalk along the front of the Hampton Inn, in the landscaped strip, must be continued across the car wash frontage.
