19880126 r-88-5RESOLUTION NO. R-88-5 A RESOLUTION TO APPROVE THE REQUEST OF FAIRFAX CIRCLE PARTNERSHIP BY BWB, INC., GENERAL PARTNER, ROY L. BROWNING, VICE PRESIDENT, FOR SPECIAL EXCEPTIONS FROM SPECIFIED PROVISIONS OF CHAPTER 26 OF THE CODE OF THE CITY OF FAIRFAX FOR PROP- ERTY LOCATED AT 9547 ARLINGTON BOULEVARD AND MORE PARTICULARLY DESCRIBED AS TAX MAP 48-3-((6))-15, 16, 19, 28 AND 28A. WHEREAS, Fairfax Circle Partnership, has submitted application No. SE-28- 87-1 requesting the Special Exceptions to the City Code listed below: Section 26-39.2(e)(1)a--to allow placement of stacking lanes and a loading space in the 25-foot front setback on Arlington Boulevard and parking spaces in the 25-foot front setback along Hume Avenue; Section 26-39.2(e)(2)--to allow a parking area to be located on the pro line without providing the required five foot landscape strip on the north- west property line adjacent to Hume Avenue; Section 26-43(b)(2)--to allow placement of two illuminated sign towers 10 feet and 81 feet respectively where 100 feet is the required separation from a residentially zoned area; and to allow illumination until 10:00 p.m. of the sign faces which are located closer than 300 feet; Section 26-44(a)--to allow a free-standing sign tower with a height of 45 feet where 20 feet is permitted and with 316 square feet of sign area, where 50 square feet is allowed; Section 26-173(c)(2)--to allow a side yard of l0 feet where 25 feet is required for an existing commercial building adjacent to a residential zoned; and Section 26-173(c)(2) and (3)--to allow a side yard and rear yard with a width of one foot at its narrow point where a minimum 25-foot landscaped area is required and to allow a building to be constructed within the re- quired setback established by 45 degree angle of bulk plane at the juncture of the two main lots. WHEREAS, City Council has determined that the proposed Special Exceptions are appropriate because the proposed development meets the requisites estab- lished by Fairfax City Code Sections 26-39(c), 26-48(b) and 26-173(f)(2) for the following reason: The project will upgrade lots 15, 16, 19, 28 and 28A at the important entrance to the City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 26th day of January , 1988, that application No. SE-28-87-1 be and hereby is APPROVED.
