R-88-6 A RESOLUTION TO DENY THE REQUEST OF WILLS COMMERCIAL, INC., BY MARTHAjO'KEEEE, VICE PRESIDENT, MARKETING, FOR SPECIAL EXCEPTION FROM SPECIFIED PROVISIONS OF CHAPTER 26 OF THE CODE OF THE CITY OF FAIRFAX FOR PROPERTY LOCATED AT 11092, 11094 AND 11096 LEE HIGHWAY AND MORE PARTICULARLY DESCRIBED AS TAX MAP 57-1((2)) LOTS 30 AND 34. WHEREAS, Wills Commercial, Inc., has submitted application No. SE-27-87-1 requesting the Special Exception to the City Code listed below: Section 26-39.4(b)(3): To reduce the number of required parking spaces to 120. WHEREAS, City Council has carefully considered the application, the recom- mendation of the staff and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exception is not appropriate because the proposed development does not meet the requisites established by the Fairfax City Code Sections 26-39.7(a) for the following reasons: The uses within the development are of a nature that peak parking demands occur at different times so that parking spaces are generally available for each use in accordance with the applicable standards. 2. The applicant still alter the construction plans by reducing building square footage and have sufficient parking for retail/service uses. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax, on this 26th day of January , 1988, that application No. SE-27- 87-1 be and hereby is DENIED.
