A RESOLUTION TO APPROVE THE REQUEST OF LEE HIGHWAY 3OINT
VENTURE, BY SHAHRAM YAVARI, GENERAL PARTNER, FOR
SPECIAL EXCEPTION FROM SPECIFIED PROVISIONS OF CHAPTER 26
OF THE CODE OF THE CITY OF FAIRFAX FOR PROPERTY LOCATED AT
10195 LEE HIGHWAY AND MORE PARTICULARLY DESCRIBED AS
TAX MAP #7-4-((2))-LOT 10.
WHEREAS, Lee Highway 3oint Venture, has submitted application No. 5E-31-88-1
requesting the Special exception to the City Code listed below:
Section 26-173(c)(1): To allow parking to encroach 12 feet into the required 2~-
foot landscaped front yard.
WHEREAS, City Gouncil has determined that the proposed Special Exception is
appropriate because the proposed development meets the requisites established by
Fairfax City Code Section 26-173(fX2) for the following reasons:
a. Will not result in a development which is disproportionate to surrounding
land uses in size, bulk or scale;
b. Will not adversely affect any nearby residential areas;
c. Will not overburden the community facilities existing or available or result
in the obstruction of light and air, danger and congestion in transportation,
or increased danger from fire, flood or other hazards;
d. Will not be contrary to the objectives specified in the Comprehensive Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairtax on this 23rd day of February, 1988, that application No. SE-31-88-1 be and
hereby is APPROVED.
