R-88-52 A RESOLUTION TO APPROVE THE REQUEST OF COMPSON DEVELOPMENT LIMITED PARTNERSHIP, BY JAMES COMPARATO, GENERAL PARTNER, FOR SPECIAL EXCEPTION FROM SPECIFIED PROVISION OF CHAPTER 26 OF THE CODE OF THE CITY OF FAIRFAX FOR PROPERTY LOCATED AT 3911 THROUGH 3929 OLD LEE HIGHWAY AND MORE PARTICULARLY DESCRIBED AS TAX MAP 57-2-((2))-176 AND 57-4-((2))-177 & 178. WHEREAS, Compson Development Limited Partnership has submitted applica- tion No. SE-41-88-1 requesting the special exception to the City Code section listed below: Section 26-39.7(a): to allow a 9.0 percent reduction in the number of required parking spaces for a mixed use development' WHEREAS, City Council has determined that the proposed special exception is appropriate because the proposed development meets the requisites established by City of Fairfax Code Section 26-39.7(a) for the following reasons: A. The uses within such development shall be of such a nature that major parking demands occur on different days of the week or during different hours and, because of alternative praking demands, parking spaces will be generally available for each use in accordance with the normally applic- able standards. B. Any reduction in required parking will not impair the adequate supply of light or air to adjacent property or unreasonably increase the congestion on public streets, endanger the public safety, diminish or impair estab- lished property values in the surrounding area, or in any other respect impair the health, safety, comfort and welfare of the inhabitants of the City. NOW, THEREFORE, BE IT RESOLVED by the city Council of the City of Fairfax on this 25th day of October, 1988, that application No. SE-41-88-1 be and hereby is approved with the following conditions: 1. Additional grading on the bike trail and removal of two trees in the bike trail easement before occupancy of the next phase of the project. 2. Landscaping on the front berm be supplemented with additional large shrubs, including evergreens, to provide complementary landscaping for the project. 3. The appropriate contribution be made for the traffic light at the main entrance to Fairfax Commons to be upgraded by the applicant to the City's new standard - mast arm type structure. 4. On-street lighting be provided in the landscaped front yard to meet the stand- ards in the City's Community Appearance Plan. 5. The landscaping in the front yard be upgraded to meet the City's Community Appearance Plan. 6. The retail and service uses be limited to those listed in the applicant's statement of support, as modified to delete video and ice cream stores, but allowing a bakery and that these uses be limited to a total of 50,000 square feet within the project. 7. The building-mounted signage be uniform using the style, color and materials already present on the first two buildings. (The signs consist of individual, black plastic letters.) R-88-52 -2- 8. A contribution of $10,000 to assist in the design of a public/private garage facilities to be provided to the City. 9. The applicant provide landscaped lighted plaza with benches at a cost not to exceed $9,500, details of the plaza will conform with the downtown Community Appearance Plan, details of which will be worked out with the City staff.
