A RESOLUTION TO APPROVE THE REQUEST OF JAMES A. BRANTLEY,
OWNER OF 10860 LEE HIGHWAY AND GABRIELE FIORITI, OWNER OF 10856
LEE HIGHWAY FOR SPECIAL EXCEPTION FROM SPECIFIED PROVISION OF
CHAPTER 26 OF THE CODE OF THE CITY OF FAIRFAX FOR PROPERTY
LOCATED AT 10856 AND 10860 LEE HIGHWAY AND MORE PARTICULARLY
DESCRIBED AS TAX MAP 57-1-((2))-48 AND 49.
WHEREAS, James A. Brantley and Gabriele Fioriti have submitted application
No. SE-39-88-1 requesting the special exception to the City Code section listed
below:
Section 26-173(e)(!).: to allow a building with a Floor Area Ratio (FAR) of 0.67
where a FAR of 0.5'0 is allowed.
WHEREAS, City Council has determined that the proposed special exception is
appropriate because the proposed development meets the requisites established by
City of Fairfax Code Section 26-173(f)(2) for the following reasons:
A. Will not result in development which is disproportionate to surrounding
land uses. i
B. Will not adversely affect any nearby residential areas.

Will not overburden existing community facilities or result in obstruction
of light and air, endanger traffic, or cause traffic congestion or increase
danger from fire, flood or other hazards; and
D. Will not be contrary to the objectives of the Comprehensive Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairfax on this 25th day of October, 1988, that application No.~SE-39-88-1 be and
hereby is approved with the following conditions:
The entrance on Lee Highway near the intersection of Lee Ilighway and Fair-
chester Drive be eliminated from the plans for traffic safety considerations.

The dumpster and loading space location be changed to the west side of the
building and that the dumpster wall material be architecturally compatible with
other site features.~
3. A denser planting scheme than required in the ordinance for the 20.5 foot rear
landscaped area be designed to include larger caliper trees and a heavy screen of
evergreen trees added to the existing vegetation on the residential side of the
fence for year-round screening. The caliper of trees to be at least four inches in
order to have immediate impact.' 'Ail on-site landscaping to be maintained on a
regular basis by the applicant.
4. The screening fence in the rear yard be constructed of brick or a combination of
brick and wood, such as brick piers as posts with board-on-board fencing in
between, or other design alternative of high quality as approved by the Board of
Architectural Review.

The landscaped front yards (on Lee Highway and Fairchester Drive) be designed
in accordance with the Community Appearance Plan incorporating the lighting
features of the Plan as well.
6. The trees in the front landscaped areas have a caliper of at least four inches.
Interior parking lot and building-mounted lights be 13 feet or less and a Iow level
intensity with no glare from the lights shining into the residential area. The
design must be approved by the Board of Architectural Review.

The applicant work with the Fairchester Woods Civic Association to develop a
landscaped scheme at the back of the property that could act as a focal point
and entrance to the residential neighborhood.
All on-site mechanical equipment be properly screened as required by the Board
of Architectural Review and maintained so that noise does not intrude into the
residential neighborhoods.
The site be maintained on a daily basis so that debris is not present on site. The
dumpster area should be given particular attention.
The applicant will provide a letter of credit for a term of five years to assure
his provision of the City's standard bus shelter when needed within that period.
The building must be moved toward the rear of the site to assure a 10-foot
setback from the service road, as required by Section 26-24(g).
