R-87-3 A RESOLUTION TO APPROVE THE REQUEST OF JAMES VAN VALKENBURG FOR A SPECIAL EXCEPTION FROM THE PROVISIONS OF ARTICLE II, DIVISION 6 AND ARTICLE XIII, OF CHAPTER 26, OF THE CODE OF THE CITY OF FAIRFAX FOR PROPERTY LOCATED AT 3195 OLD LEE HIGHWAY AND MORE PARTICULARLY DESCRIBED IN TAX MAP 48-3-((7))-43. WHEREAS, James Van Valkenburg has submitted application No. SE-12-86-1 requesting the Special Exception to the City Code listed below: 1. Section 26-178(c). To permit side and rear yards less than the re- quired distance as follows: North side 8.47 feet (12 feet required) South side 10.0 feet (12 feet required) Rear Yard 11.0 feet (12 feet required) (East side) WHEREAS, City Council has carefully considered the application, the recom- mendation of the staff and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposed development meets the requisites estab- lished by Fairfax City Code Section 26-39.7 C as follows: 1. Will not result in increased traffic. 2. Will not be contrary to the objectives of the Comprehensive Plan. 3. Will permit reasonable use of the property. 4. Will not adversely impact adjacent properties; and WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposed development meets the requisites estab- lished by Fairfax City Code Section 173 (f)(2) as follows: 1. Will not result in development which is disproportionate to surround- ing land uses. 2. Will not adversely affect adjacent residential areas. 3. Will not overburden the existing community facilities. 4. Will not be contrary to the objectives of the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Eairfax on this 13th day of Januars , 1987, that application No. SE-12-86-1 be and hereby is approved with the following conditions: 1. The existing perimeter landscaped areas be upgraded, per the Ordinance. 2. The North corner of the parking area be converted into a landscaped area. 3.
