A RESOLUTION TO APPROVE THE REQUEST OF TIPCO HOMES, INC.
FOR A SPECIAL EXCEPTION FROM THE PROVISION OF ARTICLE II,
DIVISION 6 OF CHAPTER 26 OF THE CODE OF THE CITY OF FAIRFAX
FOR PROPERTY LOCATED AT 10615 JUDICIAL DRIVE AND MORE
PARTICULARLY DESCRIBED AS TAX MAP 57-3-((2))-9.
WHEREAS, Tipco Homes, Inc., has submitted application No. SE-13-86-1
requesting a special exception to Section 26-39.2(e)(2) of the Code of the City of
Fairfax, Virginia, to permit a landscaped strip of 5.5 feet (12 feet required); and
WHEREAS, the City Council has carefully considered the application, the
recommendation of the staff, and the testimony received at the public hearing; and
WHEREAS, the City Council has determined that the proposed special
exception is appropriate because the proposed development meets the requisites
established by City Code Section 26-39.7(c) for the following reasons:
Will not result in development which is disproportionate to surrounding
land uses.
Will not adversely affect adjacent residential area.
3. Will not overburden the existing community facilities.
4. Will not be contrary to the objectives of the Comprehensive Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairfax on this 24th day of February, 1987, that application No. SE-13-86-1 be and
hereby is approved.
