A RESOLUTION TO APPROVE THE REQUEST OF THE MARRIOTT CORPORATION FOR SPECIAL
EXCEPTIONS FROM THE PROVISION OF ARTICLE II, DIVISION 6 OF CHAPTER 26 OF THE
CODE OF THE CITY OF FIARFAX FOR PROPERTY LOCATED AT 10521 LEE HIGHWAY, AND
MORE PARTICULARLY DESCRIBED AS TAX MAP 57-2-((2))-72B.
WHEREAS, the Marriott Corporation has submitted application No.
SE-18-87-1 requesting the Special Exceptions to the City Code as listed below:
1. Decrease the 25-foot landscape and setback requirement (Section
26-178(c)(1) to 15 feet on the Lee Highway frontage of the property;
and
2. Decrease the 12-foot side yard landscape strip requirement (Section
26-39.2(e)(2) to five feet on the western property line.
WHEREAS, City Council has carefully considered the application, the
recommendation of the staff and testimony received at the public hearing; and
WHEREAS, City Council has determined that the proposed Special Exception
is appropriate because the proposed development meets the requisites estab-
lished by Fairfax City Code Section 26-39.7(c) and Section 26-178(f)(2) for
the following reasons:
Section 26-39.7(c):
1. Will not result in increased traffic condition or otherwise negatively
impact existing traffic flow or pedestrian or vehicular safety; and
2. Will not be contrary to the objectives specified in the Comprehensive
Plan; and
3. Will permit the reasonable use of the subject property; and
4. Will not adversely impact adjacent property or the surrounding area.
Section 26-178(f)(2):
1. Will not result in development which is disproportionate to surround-
ing land uses; and
2. Will not adversely affect adjacent residential areas; and
3. Will not overburden the existing community facilities; and
4. ~ill not be contrary to the objectives of the Comprehensive Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax
on this 26th day of May , 1987, that application No. SE-18-87-1
be and hereby is approved.
