A RESOLUTION TO APPROVE THE REQUEST OF THE
FAIRFAX VILLAGE GREEN, INC. FOR SPECIAL EXCEPTION
FROM THE PROVISION OF ARTICLE II, DIVISION 6 OF
CHAPTER 26 OF THE CODE OF THE CITY OF FAIRFAX FOR
PROPERTY LOCATED AT 3980 UNIVERSITY DRIVE AND MORE
PARTICULARLY DESCRIBED AS TAX MAP 57-4-(2)-107.
WHEREAS, the Fairfax Village Green, Inc. has submitted application
No. SE-17-87-1 requesting a special exception to City Code Section
26-39.2(e)(1) to waive the landscaped requirement of two feet and sixteen feet
for the frontage on University and North Streets respectively; and
WHEREAS, City Council has carefully considered the application, the recom-
mendation of the staff and testimony received at the public hearing; and
WHEREAS, City Council has determined that the proposed special exception
is appropriate because the proposed development meets the requisites estab,
lished by Fairfax City Code Section 26-39.7(c) for the following reasons:
1. Will not result in increased traffic congestion.
2. Will not be contrary to the objectives of the Comprehensive Plan.
3. Will permit reasonable use of the subject property.
4. Will not adversely affect adjacent residential area.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax
on this 23rd day of June, 1987, that application No. SE 17-87-1 be and hereby
is approved.
