19860325 r-86-9RESOLUTION NO. R-86-9 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTIVE A DEED CONVEYING THE FAIRFAX ELEMENTARY SCHOOL PROPERTY TO ROBERT 3. LEWIS AND TO EXECUTE A LEASE CONVEYING, FOR A TERM OF THIRTY-FIVE YEARS, WITH OPTIONS TO RENEW, A PORTION OF THE OLD FAIRFAX ELEMENTARY SCHOOL ANNEX PROPERTY TO ROBERT 3. LEWIS WHEREAS, on August 28, 1984, the City Council of the City of Fairfax adopt- ed, by a vote on five to one, an ordinance for the sale of the Fairfax Elementary School provertv, approximated 1.9gl acres containing the school building of 33,625 square feet, Tax Map No. _57-~-2-13g, to the highest and best bidder and further directed the City Manager to request and receive bids for the oroperty; and WHEREAS, all of the bids received were rejected by City Council, and City Council subsequently entered into negotiations with the highest and best bidder, Mr. Robert 3. Lewis; and WHEREAS, an agreement for the sale of the property, including specified terms and conditions for its future use, was ultimately achieved by the oarties, and all conditions precedent for the sale of the oroperty have been met; NOW, THEREFORE, BE IT RESOLVED that the City Manager is hereby author- ized to execute, on behalf of the City of Fairfax and this Council, a deed conveying the Fairfax Elementary School Property to Robert 3. Lewis, and all other documents necessary for settlement; Drovided, however, that the City Attorney shall have certified that the deed and related documents are vroDer in form and in accordance with the agreement between the rattles; and BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute, on behalf of the City of Fairfax and this Council, a lease conveying to Robert 3. Lewis, for a term of thirty-five years, with ovtions to renew, the rear portion of the avvroximately one acre varcel occupied by the Old Fairfax Elementary School Annex; provided, however, that the City Attorney shall have certified that the lease is proper in form and in accordance with the terms and conditions pre- viously agreed upon by the varties.
