A RESOLUTION TO APPROVE THE REQUEST OF TASSOS TRIARHOS FOR
AN AMENDMENT TO A SPECIAL EXCEPTION FROM THE PROVISIONS OF
ARTICLE II, DIVISION 6, OF CHAPTER 26 OF THE CODE OF THE
CITY OF FAIRFAX FOR PROPERTY LOCATED AT 10501 3UDICIAL
DRIVE AND t~lS0 CHAIN BRIDGE ROAD AND MORE PARTICULARLY
DESCRIBED AS TAX MAP 57-tt-((2))-29, AND 30.
WHEREAS, Tassos Triarhos has submitted application No. SE-7-86-2 requesting
an amendment to a Special Exception to Section 26-39.2(E)(l)(a)i and
WHEREAS, City Council approved a Special Exception on 3anuary 28, 1986, to
permit an off-street parking area which is separated from the public right-of-way by
a 1#' landscaped strip instead of the 25' requiredl and
WHEREAS, the applicant is now requesting that the 14' landscaped strip be
reduced to 9' in order to accommodate a brick wall and landscaping in an additional
5' strip adjacent to the north wall of the proposed restaurant structurel and
WHEREAS, City Council has carefully considered the application, the recom-
mendation of the staff and testimony received at the public hearingl and
WHEREAS, the proposed project will result in improved site design and traffic
flowl and
WHEREAS, City Council has determined that the proposed Special Exception 1)
will not be contrary to the objectives of the Comprehensive Plan, and 2) will permit
reasonable use of the subject property, and 3) will not adversely impact adjacent
property or the surrounding areal
NOW, THEREFORE, BE IT RESOLVED by the City of Fairfax City Council on
this 13th day of May, 1986, that application No. SE-7-86-2 be and hereby is approved.
