RESOLUTION NO. R-80-11 WHEREAS, the City of Fairfax, Virginia, deems it necessary to improve School Street by constructing sidewalks for safer pedestrian travel; curbs and gutters for improved drainage; and driveway cuts and new paving to im- prove vehicular travel from Chain Bridge Road (Route 123) to the termi- nation of School Street; and WHEREAS, it is necessary for the said City to acquire certain dedi- cations and temporary construction easements for such purposes; and WHEREAS, the bona fide efforts of said City to acquire said dedications and temporary construction easements from the owners of certain parcels of land by means of purchase have proved unsuccessful; and WHEREAS, it appears that it will be necessary for the City to exercise its right of eminent domain in order to acquire certain of the said dedi- cations and temporary construction easements; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRFAX, VIRGINIA: 1. The City of Fairfax, Virginia, declares the necessity for ac- quisition of dedications and temporary construction easements for public street purposes across and on certain parcels of land in the City of Fair- fax, Virginia, hereinafter listed, for the improvement of School Street; 2. The City of Fairfax, Virginia, declares the necessity for the exercise of its powers of condemnation to acquire said dedications and temporary construction easements; 3. The City of Fairfax, Virginia, authorizes its City Attorney to proceed to acquire said dedications and temporary construction easements by appropriate legal means and to file and pursue condemnation actions to this end; and 4. The said dedications and temporary construction easements which are the subject of this resolution are the following: (a) A dedication and temporary construction easement shown on the attached plat designated "Al" across a certain parcel owned by Virgil To Payne, said property having been acquired by deed recorded in Deed Book 660 at Page 315 among the land records of Fairfax County, Virginia. R-80-11 -2- (b) A dedication and temporary construction easement shown on the attached plat designated "A3" across a certain parcel owned by Stanley W. Smith, said property having been acquired by deed recorded in Deed Book 940 at Page 11 among the land records of Fairfax County, Virginia. (c) A dedication and temporary construction easement shown on the attached plat designated "A4" across a certain parcel owned by Stanley W. Smith, said property having been acquired by deed recorded in Deed Book 711 at Page 6 among the land records of Fairfax County, Virginia. (d) A dedication and temporary construction easement shown on the attached plat designated "A5" across a certain parcel owned by James A. & Phyllis M. Harris, said property having been acquired by deed recorded in Deed Book 1904 at Page 46 among the land records of Fairfax County, Virginia. (e) A dedication and temporary construction easement shown on the attached plat designated "A6" across a certain parcel owned by Jean Carter, said property having been acquired by deed recorded in Deed Book 4341 at Page 42 among the land records of Fairfax County, Virginia. (f) A dedication and temporary construction easement shown on the attached plat designated "A7" across a certain parcel owned by Lottie M. Ford, said property having been acquired by deed recorded in Deed Book 4510 at Page 608 among the land records of Fairfax County, Virginia. (g) A dedication and temporary construction easement shown on the attached plat designated "A8" across a certain parcel owned by Henry & Carrie Conic, said property having been acquired by deed recorded in Liber F-10 at Page 455 among the land records of Fairfax County, Virginia.
