RESOLUTION RELATIVE TO THE ACKNOWLEDGMENT
OF VOLUNTEER FIREFIGHTERS AND LIFESAVING
MEMBERS OF THE FAIRFAX VOLUNTEER FIRE
DEPARTMENT AS EMPLOYEES FOR THE PURPOSES
OF THE VIRGINIA WORKMEN'S COMPENSATION ACT
WHEREAS the Council of the City of Fairfax, Virginia,
desires to provide the citizens of the City of Fairfax, Virginia,
with modern and capable fire protection and rescue service in
the most efficient manner possible; and,
WHEREAS, the Fairfax Volunteer Fire Department, Inc.,
(hereinafter referred to as "FVFD"), was incorporated in the Stat
of Virginia for the purpose of protecting and safeguarding the
lives, property and interests of persons and property holders in
the City of Fairfax, Virginia and the County of Fairfax, Virginia,
from the danger and ravages of fire; and,
WHEREAS, pursuant to section 65.1-4.1 of the 1950 Code of
Virginia, as amended, volunteer firefighters and lifesaving
members of the FVFD shall be deemed employees of the City of
Fairfax, Virginia, provided that the Council of the City of
Fairfax, Virginia adopts a resolution which acknowledges such
volunteer firefighters and lifesaving members of the FVFD as
employees for the purposes of the Virginia Workmen's Compensation
Act; and,
WHEREAS, pursuant to the terms of an Agreement made on
April 5, 1977, by and between the City of Fairfax, Virginia and
the FVFD, the City of Fairfax, Virginia shall adopt a resolution
to acknowledge active volunteer firefighters and lifesaving
members of the FVFD who meet the physical requirements of
section 27-40.1 of the 1950 Code of Virginia, as amended, and any
requirements of the City's workmen's compensation insurance
carrier, as employees for the purpose of obtaining workers

compensation insurance coverage in the event of disability in the
performance of emergency fire and rescue operations; and,
WHEREAS, the Council of the City of Fairfax, Virginia, desire
to adopt such a resolution.
NOW, THEREFORE, BE IT RESOLVED that the Council of the
City of Fairfax, Virginia, does hereby acknowledge active voluntee
firefighters and lifesaving members of the FVFD who meet the
physical requirements of section 27-40.1 of the 1950 Code of
Virginia, as amended, and any requirement of the City's workmen's
compensation insurance carrier, as employees for the purpose of
obtaining workers compensation insurance coverage in the event of
disability in the performance of emergency fire and rescue
operations.
