WHEREAS, the Uniform Statewide Building Code imposes cer
requirements upon the construction, repair, alteration, enlarge-
ment, restoration and moving of existing buildings and structures;
and,
WHEREAS, section 317.1 of the said Building Code provides
that the aforesaid requirements of said Building Code shall not be
mandatory for existing buildings or structures which have been
identified and classified by the local government authority as
historic buildings; and,
WHEREAS, pursuant to section 13 of the Zoning Ordinance of
the City of Fairfax, Virginia, those buildings and structures whicl
existed within the Old and Historic Fairfax District in 1900 or
prior thereto have been designated as having a particular historic
interest to the City of Fairfax,'Virginia; and,
WHEREAS, in order to promote the general welfare through the
preservation and protection of historic places and areas of histor~
interest in the City, the Council of the City of F~irfax, Virginia,
deems it appropriate to designate such buildings and structures
which existed within the Old and Historic Fairfax District in 1900
or prior thereto as historic buildings within the meaning of
section 317.1 of the Uniform Statewide Building Code.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF FAIRFAX, VIRGINIA, that buildings and structures which existed
within the Old and Historic Fairfax District in 1900 or prior there.
to be, and the same hereby are, identified and classified as
historic buildings within the meaning of section 317.1 of the
Uniform Statewide Building Code. The provisions of the said
Building Code relating to the construction, repair, alteration,
enlargement, restoration and moving of such buildings and structur~
shall not be mandatory, subject to the approval of the Building
Code and Appeals Board when such buildings or structures are

judged by the building official to be safe and in the public's
interest of health, safety and welfare regarding any proposed
construction, alteration, repair, enlargement, relocation and
location within the fire limits. All such approvals must be
based on the applicant's complete submission of professional
architectural and engineering plans and specifications bearing the
professional seal of the designer.
