19750902 r-75-21RESOLUTION NO. R-75-21 WHEREAS, the City of Fairfax, a body corporate and politic, has joined into an agreement with other corporate political bodies under the authority granted in the Washington Metropolitan Area Transit Regulation Compact; and WHEREAS, these same several political subdivisions have entered into a binding contract, commonly called the Capital Contributions Agreement, dated March 13, 1969, for the purpose of financing the construction of the Metrorail system; and WHEREAS, this said Capital Contributions Agreement gives the City of Fairfax the right to approve any changes in the so called Vienna Line in accordance with Article II, Paragraph 2.1, which states in part, "no such revision, alteration or amendment which would reduce the facilities to be constructed in accordance with the Adopted Regional System - 1968 (Revised) within any Political Subdivision (or in the case of the City of Fairfax and the City of Falls Church, reduce the facilities serving such Political Subdivision) shall be adopted without the consent of such Political Subdivision."; and WHEREAS, the City of Fairfax has been advised that the County of Fairfax, a party to the said Capital Contributions Agreement, has unilaterally requested the Washington Metropolitan Area Transit Authority to study the feasibility of moving the Metro station from the Nutley Road location to a new location in the vicinity of Tyson's Corner; NOW, THEREFORE BE IT RESOLVED, that: 1.The City of Fairfax does not agree to this proposed move of the stations on the Vienna line outside the beltway. 2. The City of Fairfax strongly objects to the expenditure of any funds of the Transit Authority for the purpose of studying a change which is, because of our statement in 1 above, a violation of the Capital Agreement (contract). R-75-21 -2 3. Should Fairfax County insist on such a study, said County be required to pay the total cost of said study, in advance. 4. The City Manager is directed to send a copy of this resolution to the General Manager of the Washington Metropolitan Area Transit Authority, the Executive Secretary of the Northern Virginia Transportation Commission, the members of the Board of the Washington Metropolitan Area Transit Authority, and each jurisdiction which is a party signator to the Capital Contributions Agreement.
