19740521 r-74-13RESOLUTION NO. R-74-13
WHEREAS, it has been evident to appropriate staff
officials of the City for many months that the property on
Routes 29-211-50 known as the Washington Motel has been unin-
habited, by paying clientele, and that it has since that time
been inhabited and frequented by various trespassers and transients;
and
WHEREAS, for at least the past year the property has
been allowed to deteriorate to a state of maintenance inconsistent
with the preservation of the health, safety and morals of the
community, as evidenced by recent recommendations of the health
and fire inspectors that the property be abated; and
WHEREAS, at approximately 4:00 p.m. this afternoon,
May 21, 1974, there occurred a fire on the aforesaid premises,
which fire, in the opinion of the County Fire Marshal's office,
is suspicious in origin, and which is an example of the dangers
befalling our citizens if this hazard is allowed to continue
unabated;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Fairfax, Virginia:
1. That the City Manager be instructed that not
later than tomorrow, May 22, 1974, the owners of the aforesaid
motel be given 10 days notice of the City's intention to abate
the nuisance by destroying and removing the offending property
in its entirety and to perfect a lien against the real estate
for the expenses thereby incurred; and~
2. That the staff be instructed forthwith to
institute bid procedures with a view to hiring a suitable, bonded
firm to undertake demolition of the aforesaid structures as soon
after the expiration of the 10 days notice as may be
practicable; and
3. That if before the beginning of demolition,
the owner is able to show reasonable cause why the demolition
should not be pursued, or if he is able to demonstrate to the
R-74-13 ~ ~
satisfaction of the City Manager that he will, within a reasonable
time, see to the demolition himself then the demolition will be
postponed by the City for such time as is deemed reasonable by the
City Manager, provided that the owners shall be charged for those
expenses and costs, if any, for which the City may have become
liable because of bidding or other procedures related to the
demolition.
