RE SOLUT I ON
WHEREAS, the City of Fairfax, Virginia, plans to enlarge
the capacity of its water storage facilities in Loudoun County,
Virginia; and
WHEREAS, it is necessary for the said City to acquire
certain properties in Loudoun County for such purposes; and
WHEREAS, it appears that it will be necessary for the
City to exercise its right of eminent domain in order to acquire
certain of the said properties;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF FAIRFAX VIRGINIA:
1. The City of Fairfax, Virginia, declares the neces-
sity for acquisition of certain parcels of land in Loudoun County,
Virginia, hereinafter listed, for the enlargement of its water
storage facilities and purposes related thereto in Loudoun County,
Virginia;
2. The City of Fairfax, Virginia, declares that a
public necessity and essential public convenience exists for
entry on the said properties by the City, its agents, contractors
and employees for said purposes at the earliest practicable date
and an emergency exists in the need for said facilities and in
the construction schedule therefore, justifying entry on the said
properties at the earliest practicable date;
3. The City of Fairfax, Virginia, declares the neces-
sity for the exercise of its powers of condemnation to acquire
said properties, hereinafter listed;
4. The City of Fairfax, Virginia, authorizes its City
Attorney to proceed to acquire said properties by appropriate
legal means and to file and pursue condemnation actions to this
end; and
5. The said properties which are the subject of this
resolution are the following;

66 acres more or less of land belonging to Lee E.
and Marion A. Youngs and acquired by them by deeds
recorded in deed book 418 at page 441 and deed
book 14C at page 278 among the land records of
Loudoun County, more particularly shown on a plat
of said property dated April, 1967, prepared by
DeLashmutt Associates, which is incorporated here-
in by reference.

110 acres more or less of land belonging to
Dr. Claude Moore and acquired by him by deed re-
corded in deed book 411 at page 138 among the
land records of Loudoun County, more particularly
shown on a plat of said property dated April, 1967,
prepared by DeLashmutt Associates, which is incor-
porated herein by reference.

119 acres more or less of land belonging to
Gerhard A. and Marion P. Gesell and acquired
by them by deeds recorded in deed book 341 at
page 488, deed book C14 at page 175 and deed
book 367 at page 76 among the land records of
Loudoun County, more particularly shown on plat
of said property dated April, 1967, prepared by
DeLashmutt Associates, which is incorporated herein
by reference.

Parcel One - 143 acres more or less of land be-
longing to Norman Bernstein and acquired by him
by deeds recorded in deed book 480 at page 163
and deed book 480 at page 166 among the land re-
cords of Loudoun County, more particularly shown
on a plat of said property dated April, 1967, pre-
pared by DeLashmutt Associates, which is incor-
porated herein by reference.
Parcel Two - 9 acres more or less of land belong-
ing to Norman Bernstein and acquired by him by
deeds recorded in deed book 480 at page 163 and
deed book 480 at page 166 among the land records
of Loudoun County, together with certain easements,
all of which is more particularly shown on a plat
of said property dated January, 1969, prepared by
DeLashmutt Associates, which is incorporated herein
by reference.

2 acres more or less of land belonging to, now or
formerly William M. Kricker, Trustee, and acquired
by him by deed recorded in deed book 436 at page
611 among the land records of Loudoun County, to-
gether with certain easements, all of which is more
particularly shown on a plat of said property dated
January, 1969, prepared by DeLashmutt Associates,
which is incorporated herein by reference.
4 acres more or less of land belonging to N. R.
Smith and acquired by him by deed recorded in deed
book 442 at page 575 among the land records of
Loudoun County, together with certain easements,
all of which is more particularly shown on a plat
of said property dated January, 1969, prepared by
DeLashmutt Associates, which is incorporated herein
by reference.
Passed by the City Council of the City of Fairfax, Vir-
ginia, in a regular meeting this first day of April, 1969.
