RESOLUTION
WHEREAS the City of Fairfax deems it necessary for
public purposes to acquire for park and recreational use those
two parcels of land containing 6.79 acres and 13.21 acres,
respectively, owned by Barbara E. Duras Scott, wife of
William R. Scott, situated on the northwest side of Old Lee
Highway (Route 237), southwest of the property of St. Leo's
Catholic Church, north of the property of the Fairfax City
School Board, and east of Layion Hall Subdivision; as shown on
City of Fairfax Tax Map Number 57-2, Section 2, Parcels 175 and
176; and
WHEREAS the City of Fairfax has heretofore made a bona
fide offer of purchase to the owner of the aforesaid parcels which
offer has been rejected and no agreement can be reached between
the City of Fairfax and said owner on the compensation to be paid
therefor
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Fairfax, Virginia that a public necessity exists for the
acquisition of the aforesaid parcels of land and BE IT FURTHER
RESOLVED that the City Attorney shall forthwith institute proceedings
to acquire said lands by condemnation.
