PUBLIC HEARING AND CONSIDERATION OF A RESOLUTION AUTHORIZING THE
EXERCISE OF "QUICK -TAKE" POWERS, TO INCLUDE THE INITIATION OF
CONDEMNATION PROCEEDINGS, FOR THE ACQUISITION OF CERTAIN FEE SIMPLE
RIGHT(S)-OF-WAY AND EASEMENTS, ON VARIOUS PROPERTIES, FOR THE
BLENHEIM BOULEVARD MULTIMODAL IMPROVEMENTS PROJECT

WHEREAS, the City determined it necessary to undertake the Blenheim Boulevard Multimodal
Improvements Project ("Project"), further identified as State Project Number U000-151-R94, RW 201
and UPC 107013, to improve the safety of pedestrian, bicycle, and vehicular traffic through the City;
and
WHEREAS, the Project aims to upgrade multimodal facilities from Old Town Fairfax to Fairfax Circle
via separated bicycle lanes, upgraded pedestrian and transit amenities, and improved traffic operations,
lighting, and landscaping;
WHEREAS, the Project requires the City to acquire numerous real property interests, including fee
simple right(s)-of-way and easement(s), for the construction, maintenance, and/or operation of the
Project; and
WHEREAS, the real property interests that are necessary for acquisition (collectively, the "Real
Property Interests") have been identified below as "To Be Acquired Properties," which are located
within the municipal boundaries of the City; and
WHEREAS, the Real Property Interests for each of the To Be Acquired Properties are detailed below;
and
WHEREAS, the City reviewed the acquisition of the Real Property Interests for purposes of complying
with Section 1-219.1 of the Code of Virginia, and has certified that the acquisitions are for a permissible
public purpose, which is to improve the safety of pedestrian, bicycle, and vehicular traffic through the
City; and
WHEREAS, the City made bona fide but ineffectual efforts to purchase the Real Property Interests
from the property owners of the To Be Acquired Properties, as required by Section 25.1-204 of the Code
of Virginia; and
WHEREAS, the City determined it necessary to acquire such Real Property Interests through the
exercise of eminent domain, authorized by Sections 15.2-1900 et seq. and 25.1-300, et seq. of the Code
of Virginia, and by Section 2.7(b) of the City's Charter; and
WHEREAS, a public hearing was held on June 24, 2025, as required pursuant to Section 15.2-1903(B)
of the Code of Virginia; and
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fairfax, Virginia, that
condemnation utilizing "quick -take" procedures of the To Be Acquired Properties is necessary, for the
reasons set forth in this Resolution, and staff is hereby authorized to initiate condemnation proceedings,
including possession prior to the institution of the condemnation proceedings, in accordance with
applicable law.
