2025-05ORDINANCE NO.2025-05 AN ORDINANCE TO AMEND THE ZONING MAP OF THE CITY OF FAIRFAX, VIRGINIA FROM RM RESIDENTIAL MEDIUM TO CU COMMERCIAL URBAN IN THE OLD TOWN FAIRFAX TRANSITION OVERLAY DISTRICT (TOD); ON THE LAND KNOWN AS 4131 CHAIN BRIDGE ROAD (AKA DAVIES PROPERTY) AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 57-4-02-040. WHEREAS, The Hill, A Davies Family LLC, applicant, by Bean, Kinney & Korman, PC, agent/attorney, submitted application No. Z-23-00073 requesting a change in the zoning classification from RM Residential Medium to CU Commercial Urban, for the parcel identified above, and more specifically described as: Beginning at a beginning at a point on the easterly right of way line of Chain Bridge Road, Virginia Route 123; said point also being the south west corner of the land of F&M Bank Northern Virginia as recorded in Deed 9896 at Page 237 among the land records of Fairfax County, Virginia; thence departing the easterly right of way line of said Chain Bridge Road running with the southerly line of said F&M Bank Northern Virginia S 66°27'25" E a distance of 542.84 feet to a point; said point being on the westerly right of way line of University Drive, thence running with the westerly right of way line of said University Drive S 15°26'35" W a distance of 211.73 feet to point; said point also being the north east corner to the land of 4151 Chain Bridge Road, LLC as recorded in Deed Book 19501 at Page 1317 among the land records of Fairfax County, Virginia; thence running with the northerly line of said 4151 Chain Bridge Road, LLC N 66°27'25" W a distance of 575.99 feet to a point; said point being on the aforementioned easterly right of way line of Chain Bridge Road; thence running with easterly right of way line of said Chain Bridge Road the following courses and distances; N 2719'56" E a distance of 71.60 feet to point; N 21°20'17" E a distance of 100.55 feet to a point; N 271610" E a distance of 37.78 feet to the point of beginning, having an area of 117,082 square feet, or 2.6878 acres more or less. And being the same property described in that Deed dated August 9, 2015, made by Hope Davies Huntington, Vera Davies Lichtenstein and Bankhead Thornton Davies, Grantors, to The Hill, a Davies Family LLC, a Virginia limited liability company, Grantee, as recorded in the Land Records of Fairfax County, Virginia, on September 3, 2015, as Deed Book 24278, Page 1095. And being further described by metes and bounds on that certain ALTA/NSPS Land Title Survey entitled, "Perseus Chain Bridge Road" prepared by Bohler Engineering, dated January 6, 2022, last revised January 18, 2022, and consisting of two (2) sheets as follows: Beginning in the westerly right-of-way limits of University Drive (variable width right-of- way and said point of beginning also being a line of division between Parcel 1 of final subdivision plat (Deed Book 6927 Page 11; PID 57 4 02 041) on the north, and the lands of The Hill, A Davies Family LLC (Deed Book 24278 Page 1095 and Deed Book 25936 Page 1425; PID 57 4 02 040) on the south, thence departing said division line and running with said University Drive; South 15°25'19" West, 211.73 feet to the division line of said The Hill, A Davies Family LLC to the north and Inns of Court, Condominium — Unit No. 1 (Deed Book 6416 Page 639; PID 57 4 26 001) to the south, thence departing University Drive and running with said line of division; North 66°28'41" West, 575.99 feet to the easterly right-of-way line of Chain Bridge Road — Virginia Route 123 (Variable Width Right -of -Way), thence departing said line of division between said lands of Inns of Court, Condominium — Unit No. 1 to the south and The Hill, A Davies Family LLC to the north and running with said easterly right-of-way line of Chain Bridge Road the following three (3) courses and distances; 1. North 27°18'39" East, 71.60 feet, thence; 2. Continuing, North 21019'01" East, 100.55 feet, thence; 3. Continuing North 27°14'54" East, 37.78 feet, to a point in the said easterly right-of- way line of Chain Bridge Road and being a line of division between the said lands of parcel 1 of final subdivision plat to the north and The Hill, A Davies Family LLC to the south, thence departing said Chain Bridge Road and running with the said line of division; South 66°28'41" East, 542.84 feet to the point of beginning. And containing the same land area as described in the first metes and bounds legal description above. WHEREAS, the City Council has carefully considered the application, the submitted Master Development Plan, the recommendation of the Planning Commission, the recommendation of staff, and the testimony received at public hearing; and WHEREAS, the City Council has determined that the proposed rezoning is proper and in accordance with the Comprehensive Plan as well as with the pertinent provisions set forth in the Code of Virginia and the Code of the City of Fairfax, Virginia; NOW, THEREFORE BE IT ORDAINED that the above -described property be rezoned RM Residential Medium to CU Commercial Urban while retaining the Old Town Fairfax Transition Overlay District (TOD), subject to the General Development Plan dated June 2, 2025; BE IT FURTHER ORDAINED, that the above application package and General Development Plan be approved; The Zoning Administrator of the City is hereby directed to modify the Zoning Map to show the changes in the zoning of these premises, and the Clerk of the Council is directed to transmit duly certified copies of this ordinance to the applicant, Zoning Administrator, and to the Planning Commission of this City as soon as possible. This ordinance shall be effective as provided by law.
