AN ORDINANCE TO AMEND THE ZONING MAP OF THE CITY OF
FAIRFAX, VIRGINIA BY ADOPTING AMENDMENTS TO THE GENERAL
DEVELOPMENT PLAN IN THE CR COMMERCIAL RETAIL DISTRICT AND
ASSOCIATED WITH THE LAND KNOWN AS 10120 FAIRFAX BOULEVARD AND
10140-10160 FAIRFAX BOULEVARD AND MORE PARTICULARLY DESCRIBED
AS TAX MAP PARCELS 47-4-23-000-A AND 47-4-23-000-D.
WHEREAS, JDC Boulevard LLC by John H. Donegan, owner (Parcel D), SCC Boulevard
Marketplace, LLC by Joseph Chura, agent (Parcel A) by with authorization from ABTB Mid -
Atlantic L.L.C., by David Panella, Vice President of Development, submitted application No.
Z-24-00085, requesting an amendment to the General Development adopted in 2017, for the
parcels identified above, and more specifically described as follows:
PARCEL D
All those certain lots, pieces, or parcels of land, with the buildings and improvements thereon,
situated in the City of Fairfax, Virginia. Beginning at a 5/8" rebar with a cap stamped Bowler
in the northerly Right -of -Way line of Fairfax Blvd (Routes 29, 211 and 50); said point being
referenced as the "POB" on plan entitled "Existing Conditions Survey of 10120 Fairfax Blvd,
Fairfax, Virginia dated 01/30/24, by Cornerstone Energy Services; thence, N 14°01'33' W
200.46 feet to a 5/8" rebar with a cap stamped WLP; thence, N 75°57'28" E 144.71 feet to a
5/8" rebar stamped Bowler; thence, S 13°46'32" E 200.47 feet to a mag nail in the sidewalk;
thence, S 75°57'28" W 143.80 feet to the point of beginning and containing 0.66 acres, more
or less.
PARCEL A
All those certain lots, pieces, or parcels of land, with the buildings and improvements thereon,
situated in the City of Fairfax, Virginia. Beginning at a 5/8" rebar with a cap stamped Bowler
in the northerly Right -of -Way line of Fairfax Blvd (Routes 29, 211 and 50); said point being
referenced as the "POB" on plan entitled "Existing Conditions Survey of 10120 Fairfax Blvd,
Fairfax, Virginia dated 01/30/24, by Cornerstone Energy Services; thence, S 75°59'33" W
665.75 feet to a mag nail; thence, S 76'10'56" W 60.63' feet to a 5/8" rebar with cap; thence,
N 14000'27" W 28.65' feet to a rebar; thence, N 36°25"18" E 61.76 feet to a rebar with cap;
thence, N 48°55'05" E 7.74 feet to a rebar with cap; thence, N 58°24'43" E 53.04 feet to a
rebar with cap; thence, N 36°07'27" E 19.13 feet to a rebar with cap; thence, N 75°59'33" E
76.14 feet to a rebar; thence, N 65°25'42" E 66.54 feet to a rebar with cap; thence, N
49007' 15" E 195.28 feet to a rebar; thence, N 75°59'33" E 290.89 feet to rebar with cap;
thence, S 14'01'33" W 200.46 feet to the point of beginning and containing 2.49 acres, more
or less.
WHEREAS, the City Council has carefully considered the application, the submitted General
Development Plan Amendment, the recommendation of the Planning Commission, the
recommendation of staff, and the testimony received at public hearing; and
WHEREAS, the City Council has determined that the proposed rezoning is proper and in
accordance with the Comprehensive Plan as well as with the pertinent provisions set forth in
the Code of Virginia and the Code of the City of Fairfax, Virginia;
NOW, THEREFORE BE IT ORDAINED that the General Development Plan Amendment
associated with the above -described property be amended, per the attached plans last revised
on dated October 1, 2024;
BE IT FURTHER ORDAINED, that the above application package and general development
plan revised through October 1, 2024 be approved.
The Zoning Administrator of the City is hereby directed to modify the Zoning Map to show
the changes in the zoning of these premises, and the Clerk of the Council is directed to
transmit duly certified copies of this ordinance to the applicant, Zoning Administrator, and to
the Planning Commission of this City as soon as possible.
This ordinance shall be effective as provided by law.
