R-24-27RESOLUTION NO. R-24-27 A RESOLUTION APPROVING A PROPOSED AGREEMENT OF PURCHASE AND SALE FOR THE PURCHASE BY THE CITY OF CERTAIN REAL PROPERTY, TOGETHER WITH IMPROVEMENTS THEREON, LOCATED AT 4085-4087 UNIVERSITY DRIVE (IDENTIFIED AS TAX MAP NOS. 57-4-02-40-085 A, B AND C AND 57-4-02-40-087 A, B, C AND D) AND AUTHORIZING AND DIRECTING THE EXECUTION OF THE AGREEMENT OF PURCHASE AND SALE AND THE CONSUMMATION OF THE TRANSACTIONS CONTEMPLATED THEREBY WHEREAS, the City Council has determined that it is necessary and appropriate, and in the best interests of the City, to acquire the above -referenced real property (the "Property") in connection with the planned replacement of Fire Station #3, located adjacent to the Property. NOW THEREFORE BE IT RESOLVED that the City Council hereby, on behalf of the City, approves the Agreement of Purchase and Sale for the purchase of the Property as presented at the meeting in which this Resolution was considered and approved. IT IS FURTHER RESOLVED that the City Manager and City Attorney are authorized and directed to cause the Agreement of Purchase and Sale to be finalized, provided that the final Agreement of Purchase and Sale shall be substantially of the form presented. In addition, the City Council hereby authorizes and directs the City Manager to execute the same, with the concurrence of the City Attorney. Further, the Mayor and/or the City Manager are authorized and directed to execute any documents reasonably required to consummate the transactions contemplated by the Agreement of Purchase and Sale, including the execution of any closing documentation, in each case subject to the approval of the City Attorney.
