AN ORDINANCE AUTHORIZING "QUICK -TAKE" CONDEMNATION PROCEEDINGS
FOR THE ACQUISITION OF CERTAIN PERMANENT AND TEMPORARY EASEMENTS
ON PROPERTY OWNED BY WILLOWWOOD LAND, LLC AT 10270 FAIRFAX
BOULEVARD, AND HAVING TAX MAP NO.47-4-02-02-000B.
WHEREAS, the City has undertaken to install and construct certain trail improvements, and ancillary
facilities, further identified as the "George T. Snyder Trail Project" (the "Project"); and
WHEREAS, the City has determined that there is a public need to acquire the following permanent
and temporary easements on portions of real property located within the municipal boundaries of the
City, owned by WillowWood Land, LLC ("Owner"), located at 10270 Fairfax Boulevard, and having
Tax Map No. 47-4-02-02-00013 (the "Property"): (i) approximately 0.638 acres of the subject property
for a permanent trail, drainage and maintenance easement; and (ii) approximately 0.211 acres of the
subject property for temporary construction easements (collectively, the "To Be Acquired Property");
and
WHEREAS, the To Be Acquired Property is shown on the plat entitled "Plat Showing Trail, Drainage
and Maintenance Easement and Temporary Construction Easement Through Parcel B Commonwealth
Corporate Center" dated January 7, 2021, prepared by Rice Associates of Manassas, Virginia, and
attached to this ordinance as Exhibit "A"; and
WHEREAS, the City and Owner have been unable to reach agreement on the valuation for the To Be
Acquired Property; and
WHEREAS, due to the deadlines imposed in conjunction with the Project, the initiation of
condemnation proceedings utilizing "quick -take" procedures is necessary, in the City's reasonable
determination.
NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Fairfax, Virginia, that
condemnation utilizing "quick -take" procedures of the To Be Acquired Property is necessary, for the
reasons set forth in this ordinance, and staff is hereby authorized to initiate condemnation proceedings,
including possession prior to the institution of the condemnation proceedings, in accordance with
applicable law.
This ordinance shall become effective as provided by law.
