R-22-40RESOLUTION NO. R-22-40 APPROVAL AND ADOPTION OF CITY OF FAIRFAX, VIRGINIA GUIDELINES FOR IMPLEMENTATION OF THE VIRGINIA PUBLIC -PRIVATE EDUCATION FACILITIES AND INFRASTRUCTURE ACT WHEREAS, the City Council has determined, and finds, that there is a public need for the timely and efficient acquisition, design, construction, improvement, renovation, operation and maintenance, installation and implementation of education facilities, public and technology infrastructure and government facilities within the municipal boundaries of the City that serve a public need and purpose; and WHEREAS, the Virginia Public -Private Education Facilities and Infrastructure Act of 2002, codified at Code of Virginia Sections 56-575.1 et seq., as amended ("PPEA") provides authority for localities to enter into certain public -private partnerships for the development and/or operation of qualifying projects, as defined therein; and WHEREAS, the PPEA requires, prior to requesting or considering proposals for qualifying projects, that the City approve and adopt, and make publicly available, guidelines that are sufficient under the PPEA and which meet the requirements of the PPEA. NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Fairfax, Virginia, that it hereby finds that the City of Fairfax Guidelines for Implementation of the Virginia Public -Private Education Facilities and Infrastructure Act (the "Guidelines"), as presented, meet the requirements of the PPEA, are reasonable, and are otherwise acceptable as presented. IT IS FURTHER RESOLVED, that the Guidelines, as presented, are hereby approved and adopted, pursuant to the PPEA, and all procurements conducted pursuant to the PPEA shall comply with the Guidelines. IT IS FINALLY RESOLVED, that the City Manager, or designee, is hereby delegated the authority and duties contained in the Guidelines or otherwise required to fully implement the Guidelines.
