AN ORDINANCE TO ENHANCE CERTIFIED MICRO -BUSINESS
PARTICIPATION IN THE CITY'S PROCUREMENT PRACTICES.
WHEREAS, localities in Virginia are permitted to undertake actions to enhance
micro -business participation in their procurement practices and processes; and
WHEREAS, this increased participation will likely benefit current City of Fairfax
micro -businesses, and attract new micro -businesses that may seek to locate into the City, by
virtue of creating a qualified local procurement preference; and
WHEREAS, eliminating sourcing requirements for certain small purchases meeting
the threshold of the proposed new local preference will result in staff and procurement
efficiencies, and is a complement to the City's direct and indirect investments in programs
such as the Mason Enterprise Center; and
WHEREAS, the City Council desires to support and encourage these positive
outcomes.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Fairfax,
Virginia, that, in accordance with, and as permitted by, the provisions of Va. Code § 15.2-
965.2, the following measures are hereby promulgated:
1. It is hereby declared to be a policy of the City that certified micro-businesse
participation within the City, and in particular within the City's procurement
practices and processes, is to be encouraged and promoted.
2. For the purposes of this Ordinance, "micro -business" shall mean a small, women -
owned, or minority -owned business with no more than 25 employees. "Certified
micro -business" shall mean a micro -business: (i) certified by the Virginia
Department of Small Business and Supplier Diversity; (ii) having a valid business
license issued by the City; and (iii) having a principal place of business within the
City.
3. City staff shall develop and establish small purchase procedures that exempt
purchases under $25,000.00 from competitive sourcing requirements and creating
a local procurement preference for these purchases for certified micro -businesses.
The $25,000.00 threshold shall apply to each requirement (goods or services

needed for a specific program or project) and is not an annual spend threshold or
limitation. Such procedures may be incorporated into the City's Purchasing
Resolution or otherwise as determined by the Office of Procurement Services in
consultation with the City Attorney.
4. City staff shall provide technical support, outreach and education to encourage
certified micro -business participation in the procurement process.
This Ordinance shall become effective as provided by law.
