AN ORDINANCE AUTHORIZING "QUICK -TAKE" CONDEMNATION
PROCEEDINGS FOR THE ACQUISITION OF A PUBLIC STREET
DEDICATION/RIGHT OF WAY AND VARIOUS EASEMENTS ON THE
PROPERTY OWNED BY FAIRFAX REGENCY, LLC, HAVING TAX MAP NO.57-2-
02-028B.
WHEREAS, the City has undertaken to install and construct certain roadway and related
improvements in the form of an extension of University Drive from Fairfax Boulevard (Route
29) to Eaton Place (Route 1681) to improve safety and provide multimodal travel, further
identified as the "Northfax East'University Drive Extension Project" (the "Project"); and
WHEREAS, the City has determined that there is a public need to acquire the following
public street dedicatiorvright of way and various easements on a portion of real property
located within the municipal boundaries of the City, owned by Fairfax Regency, LLC (the
"Owner"), located at 10342-10412 Fairfax Boulevard, and having Tax Map No. 57-2-02-
028B (the "Property"): (i) approximately 21,824 square feet of the subject property for public
street/right of way purposes; (ii) approximately 1,176 square feet of the subject property for
permanent path sidewalk maintenance easement(s); and (iii) approximately 5,140 square feet
of the subject property for temporary construction easement(s) (collectively, the "To Be
Acquired Property"); and
WHEREAS, the To Be Acquired Property is shown on the Right of Way Plan Sheets, Project
U000-151-198 Sheet Nos. 1B, 3RW, and 3BRW, prepared by Timmons Group of Richmond,
Virginia, dated January 31, 2020 and February 3, 2020, and attached to this ordinance as
Exhibit "A"; and
WHEREAS, the City and the Owner have been unable to reach agreement on the valuation
for the To Be Acquired Property; and
WHEREAS, due to the deadlines imposed in conjunction with the Project, the initiation of
condemnation proceedings utilizing "quick -take" procedures is necessary, in the City's
reasonable determination.
NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Fairfax,
Virginia, that condemnation utilizing "quick -take" procedures of the To Be Acquired Property
is necessary, for the reasons set forth in this ordinance, and staff is hereby authorized to
initiate condemnation proceedings, including possession prior to the institution of the
condemnation proceedings, in accordance with applicable law.
This Ordinance shall become effective as provided by law.
