Resolution to approve the request of Oak Knolls Realty Corporation, by Lynne J. Strobel,
agent, for special exceptions to City Code to:
1. Reduce the minimum perimeter open space to less than 25 feet, and front and rear yard
setbacks for individual residential units to less than 20 feet as required by Section 110-
673(2);
2. Allow proposed structures to exceed the maximum height of three stories and 35 feet
as required by Section 110-673(3);
3. Allow impervious area to exceed 50% of the gross tract area for the site as required by
Section 110-673(4);
4. Allow parking and removal of vehicles for parking spaces to be dependent on moving
other parked vehicles as required by Section 110-152(d);
5. Allow utilities to be relocated in a right-of-way adjacent to the site without being
placed underground as required by Section 110-105(k).
On the premises known as 10742 to 10764 Main Street, more particularly described as tax
map parcel 57-1-02-116.
I j WHEREAS, Oak Knolls Realty Corporation, by Lynne J. Strobel, agent, has
submitted Application No. SE -14060097 requesting Special Exceptions to the City Code as
, listed above; and
WHEREAS, City Council has carefully considered the application, the
recommendation from staff, the recommendation from the Planning Commission, and
testimony received at the public hearing; and
WHEREAS, City Council has determined that the proposed Special Exceptions are
appropriate because the proposal meets the requisites established by City of Fairfax Code
Sections 110-158, 110-673 and 110-105(k) for the following reasons:
1) The requests have been designed in a manner which will complement the
character of the surrounding neighborhood with respect to building size, scale,
placement, design and use of materials;
2) The proposed design, material, texture, color, lighting, landscaping, dimension,
line, mass, roof line and height of the proposed structure or improvements will
harmonize with the surrounding buildings and area
3) The orientation and location of the proposed structure or improvement, and its
relationship to open spaces and topography, will be harmonious with the
surrounding buildings and area.
4) The design of the proposed structures and site would PROVIDE for the safe
and efficient movement of pedestrian and vehicular traffic.
5) The requests will not result in increased traffic congestion or otherwise
negatively impact existing traffic flow or pedestrian and vehicular safety.
6) The requests will not be contrary to the objectives specified in the
comprehensive plan.
7) The relief is necessary to permit reasonable use of the subject property.
8) The requests will not adversely impact adjacent property or the surrounding
area.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairfax on this 26th day of May, 2015, that Application No. SE -14060097 be and hereby is
APPROVED, as requested, with the proffered conditions revised through May 18, 2015 and
with the following conditions.
1. Development of the subject site shall be in substantial conformance with the attached
GDP/Preliminary Site Plan last revised May 11, 2015 and as may be modified by the
City Council.
