RESOLUTION TO APPROVE THE REQUEST BY NORTH STREET ASSOCIATES,
L.C., FOR A SPECIAL EXCEPTION PURSUANT TO CITY CODE SECTION 110-
185 TO ALLOW TENANT SIGNAGE GREATER THAN 3.5 FEET ABOVE THE
FINISHED FLOOR LEVEL OF THE SECOND STORY OF A MULT-TENANT
COMMERCIAL BUILDING ON THE PREMISES KNOWN AS 3975 UNIVERSITY
DRIVE AND MORE PARTICULARLY DESCRIBED AS TAX MAP 57-2-20-002.
WHEREAS, North Street Associates, L.C., has submitted Application No. SE -
15020058 requesting a Special Exception to Sec. 110- 1 80(b)(2)c 3ii to allow a tenant sign at a
height greater than 3.5 feet above the finished floor level of the second story of a multitenant
commercial building; and
WHEREAS, City Council has carefully considered the application, the
recommendation from Staff, and testimony received at the public hearing; and
WHEREAS, City Council has determined that the proposed Special Exception is
appropriate because the proposal, as modified by the conditions of approval, meets the
requisites established by City of Fairfax Code Sections 110-185 and 110-366 for the
following reasons:
1) The applicant has demonstrated that the sign requirements contained in Section 110-
180(b)(2)c 3ii will present a unique burden due the location of existing vegetation that
obstructs the view of signage placed lower than three and one-half feet above the
finished floor level of the second story;
2) The request is consistent with the Comprehensive Plan and other adopted city goals
and policies;
3) The request is in harmony with the purpose of the sign article set forth in Section 110-
176 of the City Code and the purposes of zoning ordinances set forth in Code of
Virginia 15.2-2283; and
4) The request will not adversely impact adjacent property or the surrounding area.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairfax on this 29th day of April, 2015, that Application No. 5E-15020058 be and hereby is
APPROVED, with the following condition:
1. Signage shall be in general conformance with the Sign Exhibit prepared by Art
Display Company on January 13, 2015 and revised through April 21, 2015 and Sign
Location Plan received February 10, 2015.
2. The applicant shall submit an updated Master Sign Plan to the Board of Architectural
Review for review prior to the granting of permits.
