15OLUTION TO APPROVE THE REQUEST OF NOVUS FAIRFAX GATEWAY,
BY LYNNE J. STROBEL, ATTORNEY/AGENT, FOR SPECIAL EXCEPTIONS
CITY CODE TO:
1. Reduce the number of required parking spaces required by Sec. 110-155(b)(1)c.;
2. Increase the maximum gross floor area and lot coverage for buildings and parking
structures to exceed 70 -percent as permitted by Sec. 110-783(5)(b);
3. Modify the screening materials for any mechanical or utility as required by Sec. 110-
258(c);
4. Modify the perimeter parking lot landscaping and berming as required by Sec. 110-
259(a)(1)(a);
5. Reduce the required amount of loading spaces required by Sec. 110-156(b)(1);
6. Increase the maximum building height to five stories or 69 feet, where height is
limited to five stories and 60 feet by Sec. 110-783(2);
7. Permit less than six feet of separation between parking and structures, and to allow
less than four feet of separation between structures and drive -aisles as required by Sec.
110-153(3); and
8. Allow parking area entrance ways to exceed 30 feet in width measured at the street
line as required by Sec. 110-153(4)
on the premises known as 11101 and 11091 Fairfax Boulevard and 11160 Lee Highway and
more particularly described as tax map 57-1-2-27, 31, 3 1 A and 31B.
WHEREAS, Novus Fairfax Gateway Limited Partnership, by Lynne J. Strobel,
attorney/agent, has submitted Application No. 5E-13070064 requesting Special Exceptions to
the City Code as listed above; and
WHEREAS, City Council has carefully considered the application, the recommendation from
Staff, the recommendation from the Planning Commission, and testimony received at the
,public hearing; and
WHEREAS, City Council has determined that the proposed Special Exceptions are
appropriate because the proposal meets the requisites established by City of Fairfax Code
Sections 110-158, 110-263, 110-366 and 110-783(6) for the following reasons:

The requests is consistent with the Comprehensive Plan and other adopted city goals
and policies;
The proposed structure and improvements will promote the general welfare and
protect the public health, safety and morals by tending to maintain and augment the
city tax base as a whole, generating business activity, maintaining and creating
employment opportunity, and making the city a more attractive and desirable place in
which to live.
The proposed combination of architectural elements conform to accepted architectural
principles, as contrasted with engineering standards designed to satisfy safety or
functional requirements only, and exhibit external characteristics of demonstrated
architectural and aesthetic durability.
The orientation and location of the proposed structures and improvements, and their
relationship to open spaces and topography, will be harmonious with the surrounding
buildings and area.
The design of the proposed structures and site would provide for the safe and efficient
movement of pedestrian and vehicular traffic.
The requests will not result in increased traffic congestion or otherwise negatively
impact existing traffic flow or pedestrian and vehicular safety.
The requests will not be contrary to the objectives specified in the comprehensive
plan.
The relief is necessary to permit reasonable use of the subject property.
The requests will not adversely impact adjacent property or the surrounding area.
I! NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on
:this 24th day of February, 2015, that Application No. 5E-13070064 be and hereby is
1 APPROVED, as requested, with the proffered conditions revised through February 24, 2015
and with the following condition.
Development of the subject site shall be in substantial conformance with the attached
s and associated submission materials stamped "Received February 19, 2015", and the
icant's proffer statement dated February 24, 2015.
