Resolution to approve the request by Pickett LLC, for a special exception pursuant to
City Code Section 110-185 to allow building-mounted signage in a shopping center on
retail and non-retail units of the subject building that exceeds the allowable signage area
and maximum limit per tenant; to allow building-mounted signage in a shopping center
on walls not defined as building frontage on two tenant units located on the west and
southwest corners of the subject building; to allow a ground-mounted shopping center
identification sign that exceeds the square foot limit and height maximums, and that
identifies individual tenants on the premises known 9400-9490 Main Street and more
particularly described as tax map parcel 58-3-02-029.
WHEREAS, Pickett LLC, has submitted Application No. SE-14070020 requesting
Special Exception to Sections 110-180(b)(2)(a)(2) i & ii, 110-180 (b)(2)(a)(1) and 110-181(b)
to allow building mounted signage on non-retail and retail units of the subject building that
exceeds the maximum 100 and 150 square foot limit per tenant; to allow an increase in sign
area greater than 1.5 for retail tenants and 1.0 square feet for non-retail tenants per linear foot
of building frontage; to allow building-mounted signage on walls not defined as building
frontage on two tenant units located on the west and southwest corners of the subject building;
and to allow a ground mounted sign that exceeds the 50 square foot limit and 6-foot height,
and that identifies individual tenants; and
WHEREAS, City Council has carefully considered the application, the
recommendation from Staff, and testimony received at the public hearing; and
WHEREAS, City Council has determined that the proposed Special Exception is
appropriate because the proposal, as modified by the conditions of approval, meets the
requisites established by City of Fairfax Code Sections 110-185 and 110-366 for the
following reasons:
1) The applicant has demonstrated that the sign requirements contained in Section 110-
180(b)(2)a 2ii will present a unique burden due to the location;
2) The request is consistent with the Comprehensive Plan and other adopted city
goals and policies;
3) The request is in harmony with the purpose of the sign article set forth in Section 110-
176 of the City Code and the purposes of zoning ordinances set forth in Code of
Virginia 15.2-2283; and
4) The request will not adversely impact adjacent property or the surrounding area.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairfax on this 14th day of October, 2014, that Application No. SE-14070020 be and hereby
is APPROVED, with the following conditions:
1. All signage shall be in substantial conformance with the attached Special Exception
Master Sign Plan prepared by JP2 Architects, LLC, dated September 8, 2014 and the
Sign Plan Matrix dated July 7, 2014 and revised through September 11, 2014.
2. The building-mounted signage for the two anchor tenants shall not exceed 200 square
feet.
3. Building-mounted signage for the two end caps (currently Total Wine and AAA) shall
not exceed 1.65 square feet per linear foot up to a maximum of 165 square feet on
each wall;
4. No more than one under canopy blade sign shall be permitted for each business, and
each blade sign shall not exceed four square feet.
5. The ground mounted identification sign shall not exceed 130 square feet of area per
side and 20 feet in height.
6. Prior to issuance of the sign permits, the applicant shall remove the main shopping
center pylon sign and the applicant shall remove the Einstein Bros pylon sign prior to
receiving an occupancy permit for a new tenant in that space.
