RESOLUTION TO APPROVE THE REQUEST OF ALDI INC., APPLICANT,BY
JACOB DiPIAZZA,DIRECTOR OF REAL ESTATE,FOR A SPECIAL EXCEPTION
PURSUANT TO SECTION 110-185 THE C 2 RETAIL COMMERCIAL BUILDING FRONTAGE WALL IN DISTRICT
AND HIGHWAY CORRIDOR WAY ND ALSO MORE ART IC O ABLY
KNOWN AS 11001 LEE HIGH ,
DESCRIBED AS TAX MAP PARCEL 57-1-02-128.
WHEREAS, ALDI, INC.,has submitted Application No. SE-14020056 that requests
a Special Exception to reduce the requirements of Section 110-185, which defines signage
requirements.
WHEREAS, City Council has carefully considered the application,the
recommendation of staff, and testimony received at the public hearing; and
WHEREAS, City Council has determined that the proposed Special Exception is
appropriate because the proposal meets the requisites established by City of Fairfax Code
Section 110-366 for the following reasons:
1) The request will not result in increased traffic congestion or otherwise negatively
impact existing traffic flow or pedestrian and vehicular safety;
2) The request will not be contrary to the objectives specified in the comprehensive plan;
3) The request is necessary to permit the reasonable use of the subject property;
4) The request will not adversely impact adjacent property or the surrounding area;
5) The request is the minimum necessary to afford relief;
6) The request will not adversely impact the safety and welfare of residents living in the
area; and
7) The request is in harmony with the general purpose and intent of the applicable article
of Chapter 110 of the City Code.
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of
Fairfax on this 22th day of April, 2014,that Application No. SE-14020056 be and hereby is
APPROVED, as requested with the following conditions:
1. Approval shall be in substantial conformance with the applicant's submitted materials
and plans dated 03-26-2014 and 02-11-2014. Any nonconformance shall necessitate review
and approval before City Council.
2. Delivery trucks and garbage trucks servicing the ALDI grocery store shall enter and
leave the site via the signalized entrance to accessing n the site betweenthe hours of 9 a.m. 7
and garbage trucks shall be restricted t g
p.m. Monday through Sunday.
3. ALDI-generated garbage will be picked up twice a week minimum from the store to
limit the duration that food waste will remain in the on-site dumpsters.
The motion to adopt the resolution was approved on April 22, 2014.
