RESOLUTION TO APPROVE THE REQUEST BY JOSEPH A. CAPUTO, AGENT,
FOR 11123 LEE HIGHWAY ASSOCIATES, APPLICANT, FOR A SPECIAL
EXCEPTION PURSUANT TO CITY CODE SECTION 110-158 TO ALLOW A
PARKING REDUCTION IN THE C-2 RETAIL COMMERCIAL AND HIGHWAY
CORRIDOR OVERLAY DISTRICT ON THE PREMISES KNOWN AS TAX MAP
PARCEL 57-1-02-140 AND ALSO KNOWN AS 11123 - 11149 LEE HIGHWAY.
WHEREAS, 11123 LEE HIGHWAY ASSOCIATES, has submitted Application No.
SE-11060071 requesting a Special Exception to reduce the requirements of Section 110-158,
which defines required off-street parking.
WHEREAS, City Council has carefully considered the application, the
recommendation of staff, and testimony received at the public hearing; and
WHEREAS, City Council has determined that the proposed Special Exception is
appropriate because the proposal meets the requisites established by City of Fairfax Code
Section 110-366 for the following reasons:
1) The request will not result in increased traffic congestion or otherwise
negatively impact existing traffic flow or pedestrian and vehicular safety;
2) The request will not be contrary to the objectives specified in the
comprehensive plan;
3) The request is necessary to permit the reasonable use of the subject property;
4) The request will not adversely impact adjacent property or the surrounding
area;
5) The request is the minimum necessary to afford relief;
6) The request will not adversely impact the safety and welfare of residents living in the
area; and
7) The request is in harmony with the general purpose and intent of the applicable article
of Chapter 110 of the City Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairfax on this 25th day of March, 2014, that Application No. SE-11060071 be and hereby is
APPROVED, as requested with the following conditions:
1. The applicant shall provide to the Zoning Administrator a parking tabulation when a
change in use is proposed. The parking tabulation shall reflect the parking required
by all uses along with the peak hour demand of each use as detailed in the most
current edition of the Institute for Transportation Engineers Parking Generation
Manual. Prior to the issuance of any non-residential use permits, the Zoning
Administrator shall consider the peak hour demands of all existing and proposed
uses to ensure that all uses do not exceed a peak hour demand of 106 parking
spaces, and that the mixture of all existing and proposed future uses shall not exceed
121 parking spaces based on the zoning ordinance requirements.
2. The applicant shall voluntarily restrict future tenants in the four lower level spaces
(11141, 11145, 11147, and 11149) so as to maintain the reduced parking
requirements of these spaces to uses that require 1 parking space per 400 gsf+ 1
parking space per employee that in total would result in no more than 17 parking
spaces. Any change to the cumulative parking requirements for all 4 of these lower
level spaces beyond 17 spaces will warrant a revision to this Special Exception.
3. The applicant shall install all missing parking lot landscaping and trees generally
consistent with the plan dated June 26, 2013. All planting shall occur prior to the
issuance of any non-residential use permits for the lower level tenant spaces.
