2013-19 ORDINANCE NO. 2013-19 AN ORDINANCE AMENDING CHAPTER 54,ARTICLE V, DIVISION 1, OF THE CODE OF THE CITY OF FAIRFAX,VIRGINIA,TO ADD A NEW SECTION 54-175, PERTAINING TO UNLAWFUL HUNTING. WHEREAS, state enabling authority permits municipal corporations to prohibit all hunting with firearms or other weapons within any subdivision or other area of such municipal corporation which, in the opinion of the governing body of such municipal corporation is so heavily populated as to make such hunting dangerous to the inhabitants thereof; and WHEREAS, the City Council, in furtherance of its desire to promote the health, safety and general welfare of its residents, desires to implement a prohibition against hunting within the entirety of the City, due to the City's small geographic size and density of population. NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Fairfax, Virginia, that, pursuant to the requirements of state enabling authority, and specifically Code of Virginia Section 15.2-1113.1, the City Council hereby determines that the entirety of the area encompassed by the municipal boundaries of the City is so heavily populated as to make hunting dangerous to the inhabitants of the City of population. BE IT FURTHER ORDAINED, by the City Council of the City of Fairfax, Virginia, that Chapter 54, Article V, Division 1, of the Code of the City of Fairfax, Virginia, is hereby amended to add a new Section 54-175, pertaining to unlawful hunting, which shall read in its entirety as follows: "Sec. 54-175. —Unlawful Hunting. It shall be unlawful for any person to hunt with a firearm or other weapon within the municipal boundaries of the city. For the purposes of this section, the term "hunt" shall include the killing of any game or other wildlife, for any reason, through the use of any firearm, pneumatic gun, bow or crossbow, slingshot or other instrument for projecting missiles liable to do any injury to persons, property or wildlife. The provisions of this section shall not apply to any law enforcement officer or animal control officer lawfully discharging his or her duties." BE IT FURTHER ORDAINED, by the City Council of the City of Fairfax, Virginia, that City staff is directed to erect appropriate signage, meeting the requirements of state law, designating the prohibited hunting area. This ordinance shall become effective as provided by law.
