'. An Ordinance to Provide for Annual Reassessment and Assessment of
• Real Estate in the City of Fairfax, Virginia and the Appointment of an
Assessor of Real Estate.
WHEREAS heretofore the City of Fairfax has employed a method
of assessment and reassessment of taxable real estate within the City
• pursuant to general law; and
WHEREAS by amendment to the City Charter passed by the General
Assembly of Virginia in 1964 and contained in Section 2. 4 of Chapter 2
thereof, the City is now authorized to provide for the annual assessment
and reassessment of real estate for taxation by appointing a single assessor
of real estate to assess such real estate for taxation; and
WHEREAS the City Council of the City of Fairfax, after public
hearing thereon and due consideration thereof, deems it in the public
interest to provide for an annual reassessment or assessment of taxable
real estate and to appoint a single assessor of real estate for said purpose,
to be known as the "City Assessor" of the City of Fairfax, Virginia;

be, of all taxable real estate within the corporate limits of the City of
Fairfax for purposes of taxation beginning in the year of adoption of this
ordinance and annually thereafter, to be completed by the 31st day of Au v:st
of each year in which made.

2. That without delay the City Manager shall recommend to the
City Council such person or persons qualified and willing to serve in the
capacity of City Assessor for appointment to that position by the Council.
3. That the City Assessor shall be employed at such salary and
for such term as the City Council may hereafter establish and regulate by
resolution. •
4. That said City Assessor, upon being duly appointed in accord
with law, shall head and direct a new department of city government,
hereby created, which shall be known as the "Department of Real Estate
Assessment" of the City of Fairfax, Virginia.
5. That the City Assessor, upon his appointment, shall advise
the City Council. of the technical and clerical assistance necessary to carry
out his duties.

6. That all the duties now devolved upon the Commissioner of the
Revenue of the City of Fairfax with respect to the assessment of real estate
shall be transferred to and devolve upon the City Assessor when duly
appointed and employed, and he shall prepare the land books and extend the
taxes thereon and perform-1 all the duties required by law to be performed by
the Commissioner of the Revenue in respect to real estate assessments.
7. That all real estate subject to the provisions of this ordinance
shall be assessed at its fair market value and the taxes for each year on

such real estate shall be extended on the basis of the last assessment made
prior to such year, subject to such changes as may have been lawfully made.

That the taxation of taxable real estate in the City of Fairfax,
Virginia for the tax year beginning January 1, 1966 shall be made on the
general reassessment and assessment provided for herein to be completed
prior to August 31, 1965.
9. That should any word, phrase, clause, paragraph, section,
part or provision of Lids ordinance be declared void or unlawful by any
court of competent jurisdiction, all remaining parts and provisions hereof
shall remain in full force and effect.

of assessment and reassessment of taxable real estate pursuant to general
law; and
WHEREAS, by amendment to the City Charter passed by the
General Assembly of Virginia in 1964, and contained in § 2. 4 of said City
Charter, the City is now authorized to assess and reassess taxable real
estate on an annual basis; and
WHEREAS, the City Council, after due consideration and public
hearing, deems it in the public interest to have real estate assessed and
reassessed on an annual basis;
NOW, THEREFORE, the City Council hereby ordains:
1. That there be an assessment and reassessment, as the case
may be, of all taxable real estate for taxation within the City beginning
immediately upon the adoption of this ordinance, and thereafter on an
annual basis.
2. That the City Manager forthwith employ a qualified person to
serve as the City Assessor of the City of Fairfax.
3. That said City Assessor, upon being duly appointed in accord
with law, shall establish a new department of city government, hereby
created, which shall be called "Department of Real Estate Assessment"
of the City of Fairfax, Virginia.

4. That all the duties heretofore devolved upon the Commissioner
of the Revenue with respect to the assessment of real estate are hereby
transferred to and shall devolve upon the said City AssessorAwho shall
comply with the same and with the provisions of the City Charter and
general law.
5. That the taxation of taxable real estate in the City of Fairfax,
beginning January 1, 1966, and for every year thereafter shall be made
on the assessments and reassessments made pursuant to this ordinance.

of a person to the post of City Assessor, the City Manager shall
employ such person forthwith in that capacity at such salary as
shall be within the range of compensation approved for such City
Assessor from time to time by City Council, and
4) That the term of office of the aforesaid City Assessor
shall be set by City Council at the time of the first such appoint-
ment to this post, and
5) That said City Assessor, upon being duly appointed in
accordance with law and employed as such, shall establish and head
a new department of city government, hereby created, which shall
"Department known as the Department of Real Estate Assessment" of the City
of Fairfax, Virginia, and said City Assessor shall report and be
directly responsible to the City Manager for purposes of supervi-
sion, direction and control, except as modified by the pertinent
provisions of Section 2.4 (a) of Chapter 2 of the City Charter of
the City of Fairfax, and
6) That all the duties heretofore devolved upon the Commis-
sioner of the Revenue with respect to the assessment and re-
assessment of real estate shall be transferred to and shall devolve
upon said City Assessor when duly appointed and employed, and said
City Assessor shall comply strictly with the same and with the
provisions of this ordinance and such provisions of the Fairfax
City Charter, Virginia general law and the Virginia Constitution
as may both apply and control, and
7) That the assessment and re-assessment of all taxable
real estate, beginning with such assessments and re-assessments to
be effective January 1, 1966, for tax purposes, and for each and
every year thereafter, shall be made strictly pursuant to and in
accordance with the provisions of this ordinance and of Section
2.4 of Chapter 2 of the Fairfax City Charter as amended to the
exclusion of any other way, except as modified or restricted from
time to time by the Fairfax City Charter, Virginia general law or
the Virginia Constitution as they may be amended or re-enacted, and
8) That upon any question relating to the assessment or re-
assessment of real estate for tax purposes in the City of Fairfax
on which this ordinance is silent, the pertinent provisions of the
Fairfax City Charter as amended not in conflict with statutory or
constitutional law of the Commonwealth of Virginia as amended shall
govern and control, and

9) That, anything contained in this ordinance to the contrary
notwithstanding, the provisions of this ordinance shall not apply
to real estate assessable under law by the Virginia State Corpora-
tion Commission, and
10) That all provisions of any prior motion, directive, resolu-
tion, ordinance or other action having force of law adopted, exe-
cuted or continued by the City Council of the City of Fairfax not
consistent with the provisions of this ordinance are hereby re-
scinded or repealed, and
11) That should any word, phrase, clause, paragraph, section,
part or provision of this ordinance be declared void or unlawful
by any court of competent jurisdiction, all remaining parts and
provisions hereof shall remain in full force and effect, and
12) That the provisions of this ordinance shall be effective
upon the date of its adoption.
