RESOLUTION
WHEREAS Title VII of the Housing Act of 1961 , as amended, provides for
the making of grants by the Housing and Home Finance Administrator to States
and local public bodies to assist them in the acquisition of permanent
interests in land for open-space uses where such assistance is needed for
carrying out a unified or officially coordinated program for the provision
of open-space land as part of the comprehensively planned development of the
urban area; and
WHEREAS the City of Fairfax, Virginia, herein sometimes referred to as
"Applicant", desires to acquire a fee simple interest on one parcel of land
known as Parcel No. 20A Double Circle 2, Sheet No. 58-1 , City of Fairfax Tax
Assessment Map which land in accordance with the Proposed Parks and Open
Space Plan under consideration by the Planning Commission and City Council
of the City of Fairfax, Virginia is to be held and used for permanent Open-
Space land as a park; and
WHEREAS Title VI of the Civil Rights Act of 1964, and the regulations
of the Housing and Home Finance Agency effectuating that Title, provide that °
no person shall be discriminated against because of race, color or national
origin in the use of the land acquired; and
WHEREAS it is estimated that the cost of acquiring said interests will
be $270,000.00; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRFAX,
VIRGINIA, AS FOLLOWS:
1. That an application be made to the Housing and Home Finance Agency
for a grant in an amount authorized by Title VII of the Housing Act of 1961 ,
as amended, which amount is presently estimated to be $135,000.00, and that
the Applicant will pay the balance of the cost from other funds available
to it.
2. That the City Manager is hereby authorized and directed to execute

and to file such application with the Housing and Home Finance Agency, to
provide additional information and to furnish such documents as may be re-
quired by said agency, to execute ,such contracts as are required by said
Agency, and to act as the authorized correspondent of the Applicant.
3. That the proposed acquisition is in accordance with the Proposed
Parks and Open-Space Plan under consideration by 'the Planning Commission
and City Council of the City of Fairfax, Virginia, for the preservation of
permanent open-space land, and that , should said grant be made, the City of
Fairfax will retain said land for the use designated in said application and
approved by the Housing and Home Finance Agency.
4. That the United States of America and the Housing and Home Finance
Administrator be, and they hereby are, assured of full compliance by the
Applicant with regulations of the Housing and Home Finance Agency effectuat-
ing Title VI of the Civil Rights Act of 1964.

WHEREAS Title VII of the Housing Act of 1961 provides for
the making of grants by the Housing and Home Finance Administrator
to States and local public bodies to assist them in the acquisi-
tion of permanent interests on land for Open-Space purposes where
such acquisition is deemed essential to the proper long-range
development and welfare of urban areas in accordance with plans
for the allocation of land to such purposes; and
WHEREAS the City of Fairfax, Virginia desires to acquire a
fee simple interest on one parcel of land known as Parcel No. 20
Double Circle 2, Sheet No. 58-1, City of Fairfax Property Identi-
fication Map, which land in accordance with the Parks and Open
Space Plan under consideration by the Planning Commission
and City Council of the City of Fairfax, Virginia is to be held
and used for permanent Open-Space land as a park; and
WHEREAS Title VI of the Civil Rights Act of 1964, and the
regulations of the Housing and Home Finance Agency effectuating
that Title, provide that no person shall be discriminated against
because of race, color, or national origin in the use of the land
proposed to be acquired; and
WHEREAS it is estimated that the total consideration to be
paid for the acquisition of said interest will be $270, 000.00.

and the total of all related costs from other funds available to it.
2. That the City Manager of the City of Fairfax is hereby
authorized to and directed to execute and to file such application
with the Housing and Home Finance Agency, to provide additional
information and to furnish such documents as may be required by
said Agency, and to act as the authorized correspondent of the
City of Fairfax, and the City Manager of the City of Fairfax is
hereby authorized to enter into all necessary contracts with the
Housing and Home Finance Agency.
3 . That the proposed acquisition is in accordance with the
Parks and Open Space Plan under consideration by the Planning
Commission and City Council of the City of Fairfax, Virginia, for
the preservation of permanent Open-Space land, and that, should
said grant be made, the City of Fairfax will retain said land for
