RESOLUTION TO APPROVE THE REQUESTS OF ROBERT E. STAFFORD, SR.
AND ASSOCIATES, LLLP, BY STEPHEN K. FOX, AGENT, FOR A SPECIAL
EXCEPTION PURSUANT TO CITY CODE SEC. 110-263 FOR RELIEF FROM
ZONING DISTRICT SCREENING AND FOR A SPECIAL EXCEPTION PURSUANT
TO CITY CODE SEC. 110-185 FOR REMOVAL OF TIME RESTRICTIONS ON AN
ILLUMINATED SIGN ON THE PREMISES KNOWN AS 10030 FAIRFAX
BOULEVARD FURTHER DESCRIBED AS CITY OF FAIRFAX TAX MAP
PORTION OF PARCEL 47-4-02-OO1B.
WHEREAS,Robert E. Stafford, Sr. and Associates, LLLP, has submitted Application
No. SE-11120020 requesting Special Exceptions to:
• Waive/modify the 25-foot landscape Screen C required by Section 110-258
between C-3 and C-2 zoned land; and
• Allow illumination of a sign located within 300 feet of a residential district
without the time restrictions required by Section 110-179(b)(2); and
WHEREAS, City Council has carefully considered the application,the
recommendation from Staff, and testimony received at the public hearing; and
WHEREAS, City Council has determined that the proposed Special Exceptions are
appropriate because the proposal meets the requisites established by City of Fairfax Code
Sections 110-366, 110-185 and 110-263 for the following reasons:
1) The requests are consistent with the Comprehensive Plan and other adopted
city goals and policies;
2) The requests are appropriate given the size, shape and development of the
existing parcel of record, existing lease areas and the proposed C-3 District
boundary;
3) The requests will not result in increased traffic congestion or otherwise
negatively impact existing traffic flow or pedestrian and vehicular safety;
4) The requests will not overburden the community facilities existing or available
or result in the obstruction of light and air, danger and congestion in
transportation, or increased danger from fire, flood, or other hazards;
5) The requests are in harmony with the general purpose and intent of the applicable
article of Chapter 110 of the City Code and the purposes of zoning ordinances set forth
in Code of Virginia 15.2-2283.
6) The requests will not adversely impact adjacent property or the surrounding area; and
7) The requests will not adversely impact the safety and welfare of residents living in the
area or persons working in the neighborhood.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairfax on this 24th day of July, 2012, that Application No. SE-11120020 be and hereby is
APPROVED, as requested.
The motion to adopt the resolution was approved on July 24, 2012.
