R-12-32 RESOLUTION NO. R-12-32 RESOLUTION TO APPROVE CIT� OF FAIRFAX SCHOOL BOARD, UT ANN A SUPERINTENDENT/AGENT FO R THE APPLICANT, FOR A SPECIAL EXCEPTION PURSUANT TO CITY CODE SECTION 110-158 TO REDUCE ON THE PROPERTY REQUIRED PARKING AT FAIRFAX HIGH SCHOOL TAX MAP PARCEL 58-1-02-003; ALSO KNOWN AS 3501 REBEL RUN. WHEREAS, Ann G. Monday, Superintendent/Agent for the City of Fairfax School Board, Owner/Applicant, has submitted Application No. SE-12060010 requesting a Special Exception to reduce the requirements of Section 110-155, which defines required off-street parking; and. WHEREAS, City Council has carefully considered the application, the recommendation of staff, and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Section 110-366 and 110-158 for the following reasons: 1) The request will not result in increased traffic congestion or otherwise negatively impact existing traffic flow or pedestrian and vehicular safety; 2) The request will not be contrary to the objectives specified in the comprehensive plan; 3) The request is the minimum necessary to afford relief; 4) The request will not adversely impact the safety and welfare of residents living in the area; and 5) The request is in harmony with the general purpose and intent of the applicable article of Chapter 110 of the City Code. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 12th day of June, 2012, that Application No. SE-12060010 be and hereby is APPROVED to allow the applicant the ability to reduce the amount of required parking for Fairfax High School located on the subject property, subject to the following conditions: 1. This Special Use Permit (SUP) shall be valid for a period of two (2) years. Development shall be in accordance with plans submitted with the application and prepared by Fairfax County Public Schools. 2. Should the City find it necessary to maintain the water or sewer lines in the ground beneath the temporary classrooms, as determined by the Director of Utilities, the applicant shall be responsible for all costs associated with removal and replacement of any affected temporary classroom facilities. 3.
