R-11-31 RESOLUTION NO. R -11 -31 A RESOLUTION APPROVING THE RENEWAL (EXTENSION) OF THE TERM OF THAT CERTAIN PARKING LOT LEASE AGREEMENT BY AND BETWEEN THE , LLC CITY OF FAIRFAX AS LESSEE AND THE 6 ARKING SPACES LOCATED AS LESSOR FOR APPROXIMATELY 46 OF SAGER AVENUE AND UNIVERSITY DRIVE WHEREAS, the City of Fairfax, Virginia (the "City ") has determined that there continues to be a need for additional public parking in the Old Town Fairfax area; and WHEREAS, The Business Investment Group, LLC and the City entered into a Parking Lot License Agreement effective as of June 30, 2004, for that certain parking lot owned by The Business Investment Group, LLC, and consisting of approximately 46 spaces located at the intersection of Sager Avenue and University Drive; and WHEREAS, the City has determined that it is in the best interest of the City to exercise a renewal (extension) provision contained within the Lease, to extend the term of the Lease through June 30, 2012. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax, Virginia, that the City Manager is authorized to negotiate and execute a Fourth Amendment to Lease, resulting in an extension of the term of the Lease through June 30, 2012, such Fourth Amendment to Lease to be in a form approved by the City Attorney.
